The opposed trademark "GUCHINI" and the opponent's trademark "GUCCI" are similar in word formation and pronunciation. Both trademarks are used on "glasses" and other products, which can easily cause confusion among consumers. The opposed trademark is a malicious imitation of the opponent's trademark, which violates the principle of good faith and will seriously infringe the legitimate interests of the opponent.

Based on the facts and reasons stated by the parties, our Bureau believes that:

The opposed trademark "GUCHINI" is designated for use on Class 9 "glasses" and other commodities. The opponent's trademark "GUCCI" has been registered on Class 9 "glasses" and other commodities. The opposed trademark consists of seven letters, and the opponent's trademark consists of five letters. The two trademarks are significantly different in letter composition, name, and overall appearance, and are not similar trademarks. Although they are both used on products such as "glasses", they do not constitute similar trademarks used on the same similar products. The opponent also claimed that the opposed trademark was a malicious imitation of its trademark, but did not provide any evidence to prove this. Therefore, our office does not support this objection.

According to Article 33 of the "Trademark Law of the People's Republic of China", our office ruled that the objection raised by the opponent was not valid, and the trademark No. 1752695 "GUCHINI" was approved for registration.

According to Article 33 of the Trademark Law of the People's Republic of China, if the party concerned is dissatisfied with this ruling, it may apply to the Trademark Review and Adjudication Board for review within fifteen days from the date of receipt of this ruling. .
