Trademark registration application
1. 3. Applicants from Hong Kong, Macau and Taiwan shall follow the procedures for foreign-related applicants.
There is no difference in the review of trademark registration applications between the two methods. The main difference is the slight difference in the way of contact, documents submitted, document submission and delivery methods.
Materials required to apply for a trademark:
1. Applications from other organizations: business licenses or copies of certification documents from public institutions, associations and other groups with legal person status outside the mainland. Applicants do not require such documentation.
2. For foreign and Chinese natural persons to apply, provide a clear copy of their ID card and a copy of the individual industrial and commercial license of the applicant as a legal person; the business scope of the license must be consistent with the application scope
3. Trademark pattern: It must be clear, clean, and distinct in black and white, no larger than 10 cm × 10 cm, no smaller than 5 cm × 5 cm, in 5 copies (for specified colors, 5 copies of the color trademark pattern, and 1 copy of the black and white trademark pattern).
4. Three-dimensional trademark: A drawing that can determine the three-dimensional shape must be submitted.
5. Color trademark: a text description is required.
6. Collective trademarks and certification marks: Subject qualification certification documents and usage management rules must be submitted.
7. "Trademark Agency Power of Attorney": If you entrust a trademark agency to act as an agent, you must provide a power of attorney signed or sealed by the applicant. Applicants outside mainland China who want to apply for trademark registration in China must entrust a trademark agency to represent them.
8. "Application for Trademark Registration": If an agency is entrusted to apply for registration, the agency will prepare it.
9. Special certification materials: If a portrait is used as a trademark, a letter of authorization from the portrait owner notarized by a notary authority is required.
Process for applying for trademark registration:
1. The enterprise is required to provide a copy of the business license and trademark sample and main goods or services, and submit them to the Trademark Office;
2. Formal review by the Trademark Office (7-15 working days) after receiving the "Notice of Acceptance of Trademark Registration Application";
3. Substantive review by the Trademark Office (about 5-8 months)
4. Trademark announcement (3 months);
5. Issuance of trademark registration certificate and publication of trademark registration announcement;
6. Applicant receives "Trademark Registration Certificate".
