Trademarks refer to the marks that enterprises, institutions and individual industrialists and businessmen use with distinctive characters, figures, letters, numbers, three-dimensional marks and color combinations, as well as the combination of the above elements, in order to make the goods or services they produce and operate different from those provided by others. Trademarks can be divided into two categories: commodity trademarks and service trademarks.
the exclusive right to use a trademark refers to the exclusive right enjoyed by enterprises, institutions and individual businessmen to use their registered trademarks according to law. Because trademarks have the function of expressing quality and reputation, the use of trademarks by others may damage the reputation of trademark owners and must be strictly prohibited.
The Trademark Law of the People's Republic of China (hereinafter referred to as the Trademark Law), which was revised and promulgated in April p>219, stipulates that if a natural person, legal person or other organization needs to obtain the exclusive right to use a trademark for its goods or services in production and business activities, it shall apply to the Trademark Office for trademark registration. An application for registration of a malicious trademark that is not intended for use shall be rejected.
