The trademark is invalid, but the exclusive period has not expired. Can it still be used?

Registered trademarks are protected by law, and the registrant has exclusive rights over them for a period of time. Upon expiration of the validity period, the trademark right will no longer be protected by law. The validity period of a registered trademark is 10 years, calculated from the date of approval of registration. If a registered trademark expires and needs to be continued to be used, it should apply for renewal of registration within 6 months before expiration; if the application is not submitted during this period, a 6-month extension period can be given. If the extension period expires and the application has not been submitted , cancel its registered trademark. Each subsequent exhibition registration is valid for 10 years.

Trademark extension processing:

1. If you apply directly, submit the application at the acceptance window of the trademark registration hall.

2. If the trademark agency Alibaba Cloud is entrusted to handle the application, the trademark agency will deliver the application documents to the Trademark Office.

(3) Pay the renewal fee

A fee of 2,000 yuan is required for each renewal registration application. If the renewal registration application is submitted during the extension period, a delay fee of 500 yuan is required.

If a trademark agency is entrusted to handle the matter, the Trademark Office will deduct the fee from the advance payment of the trademark agency.

Notes

1. After the renewal application is approved, the Trademark Office will issue the renewal certificate to the applicant. If you apply directly, the application will be mailed to the address filled in on the application form. Send it to the applicant; if it is through an agent, send it to the agency organization.

2. If the renewal application requires corrections, the Trademark Office will issue a notice of correction to the applicant, requiring the applicant to make corrections within a time limit. If the applicant fails to make corrections as required within the prescribed time limit, the Trademark Office has the right to disapprove the renewal application.

3. If the renewal application is disapproved, the Trademark Office will issue a "Notice of Disapproval".
