If the application procedures are basically complete or the application documents basically meet the requirements, but need to be corrected, the Trademark Office will issue the Notice of Correction of Trademark Registration Application. If the applicant makes corrections within the time limit and returns them to the Trademark Office, the date of application shall be kept; If it is not corrected or corrected within the time limit, the Trademark Office will issue a notice of rejection and return it, and the application date will not be retained.

Within three months from the date of announcement, anyone may raise an objection to the trademark preliminarily approved by the China Trademark Office.
If it is ruled that there is no objection or the objection is untenable, the China Trademark Office will approve the registration, issue a trademark registration certificate, and make an announcement in the Trademark Announcement; If the objection is established, the registration shall not be approved.

Can an enterprise name be registered as a trademark? China allows the registration of enterprise names as trademarks.
According to the spirit of China's trademark law, enterprise names can be registered as trademarks. However, when the applicant uses the enterprise name as a trademark, the enterprise name must contain a significant part, and the enterprise name applied for as a trademark should be exactly the same as the name registered in the applicant's business license.
In the application for registration, the applicant may not indicate the waiver of exclusive rights in the non-significant part of the application. Because these signs of administrative divisions, industries and enterprise organization forms cannot be used exclusively by a certain operator, they will be regarded as an automatic waiver of exclusive rights in the process of trademark registration and examination, and there is no need to specifically indicate the waiver.
It should be noted that this way of trademark registration with enterprise name is not conducive to the transfer, license and change of enterprise name in the future.
How to register a brand trademark? (1) Search:
1. Domestic applicants provide trademark registration drawings to the company's agents for new retrieval;
2. Fill in the form and pay the retrieval fee:
3. The search result (65,438+00 days) has no legal effect (no new application in the last 3-6 months can be found). After preliminary screening, the applicant decides whether to apply.
(2) Application for registration:
When applying for a registered trademark, the following documents shall be provided:
1, a copy of the business license of the enterprise (provided by the enterprise or unit), or a copy of the ID card (provided when an individual applies);
2. The trademark pattern applied for is in 10 copies (color 1 1 copy) (length and width are not more than 10cm and not less than 5 cm); Small pattern 1 serving (about 2? 4 cm in size);
3. Sign an entrustment contract with our company and pay the registration fee (official fee and agency fee);
4. The column of the trademark power of attorney is stamped and left blank;
5. The list of goods or services that need to be registered shall copy the standard terms in the International Classification of Trademarks.
Will a registered trademark be revoked if it is not used for a long time? Because the resources of a trademark are limited, its use is limited in time. Where a trademark needs to be used continuously, it can be renewed once every ten years, and there is no time limit. However, many trademarks will be abandoned by trademark holders, so they cannot be renewed. This trademark can be re-registered and used by others.
The Trademark Law stipulates that if it is not used for three consecutive years, it can be revoked. There are two kinds of penalties for not using a registered trademark for three consecutive years. If it is not inevitable, the Trademark Office may also order it to make corrections within a time limit. The concept of trademark use is very broad, not only registered goods or services, but also some works.
Professional investment in trademarks, most companies and individuals will register a large number of trademarks and sell them directly to other companies and individuals. Because of the limited trademark resources (few good trademarks), the trademark registration time is long and there is room for investment. However, not using the restrictions that may be revoked for three years does bring great restrictions. For specialized trademark investors, other use behaviors can easily be identified as invalid use, and it will be more difficult to create use facts.
Therefore, for specialized trademark investors, the best way is to transfer the registered trademark quickly within three years, because if it is used, it will also affect the value of the registered trademark itself. If it is not used for three years in a row, the ownership of the registered trademark will be in an unstable state and buyers will not buy it.
