Chapter 3 of the Admission Management Rules for New Energy Vehicle Manufacturers and Products: Access Conditions and Management

Access conditions for new energy vehicle companies:

(1) Comply with relevant national laws, regulations, rules, national automobile industry development policies and national macro-control policies.

(2) It should be a complete automobile manufacturer or a modified commercial vehicle manufacturer listed in the "Announcement"; a new automobile enterprise or an existing automobile enterprise that produces other categories of new energy automobile products across product categories , should first go through the project approval or filing procedures in accordance with the relevant national investment management regulations.

(3) Have the necessary production capabilities and conditions to produce new energy vehicle products.

(4) Have the design and development capabilities for new energy vehicle products.

(5) Have the ability to ensure the consistency of production of new energy vehicle products.

(6) Have new energy vehicle product marketing and after-sales service capabilities.

(7) Establish a parts procurement system that is compatible with the new energy vehicle products produced.

(8) The vehicle products produced comply with the requirements of relevant national standards and industry standards, technical specifications, vehicle product finalization test procedures, special technical conditions and inspection specifications applicable to new energy vehicles.

The "Access Conditions and Review Requirements for New Energy Vehicle Manufacturing Enterprises" (hereinafter referred to as the "Access Conditions") are shown in Appendix 2.

In addition to the inspection standards for conventional automobile products, new energy vehicles should also comply with the special inspection standards for new energy automobile products. For details, see the Catalog of Special Inspection Standards for New Energy Automobile Products (included in 2009 April 1)》(Annex 3). Automobile manufacturers that meet the "Access Conditions" and obtain production qualifications can produce similar new energy vehicle products (referring to the same category of products as conventional vehicles already in the "Announcement", the same below).

Refitted commercial vehicle manufacturers that meet the "Access Conditions" and obtain production qualifications can modify and produce similar new energy vehicle products. Among them, if they have the conditions for chassis production, they can make their own chassis, but the self-made chassis is limited to this country. For corporate use. New energy vehicle product access conditions:

(1) Products comply with relevant standards and regulations such as safety, environmental protection, energy saving, and anti-theft.

(2) The product has passed the testing by the testing agency designated by the Ministry of Industry and Information Technology (hereinafter referred to as the testing agency).

(3) The product does not infringe the intellectual property rights of others. Those who apply for admission as a new energy vehicle enterprise shall submit the following materials:

(1) "Application Form for Admission as a New Energy Vehicle Manufacturing Enterprise" (see Attachment 4).

(2) Description of new energy vehicle product design, production, marketing and after-sales service capabilities, parts supply system, and production consistency assurance capabilities.

(3) The enterprise’s self-assessment report in accordance with the requirements of the "Access Conditions".

(4) New automobile companies or existing automobile companies that produce other types of new energy vehicle products across product categories must first go through the project approval or filing procedures in accordance with the relevant national investment management regulations.

(5) Various materials required to apply for new energy vehicle product access. When applying for new energy vehicle product access, the following materials should be submitted:

(1) Description of the basic information of the production enterprise, including company name, shareholders, legal representative, registered trademark, registered address and production address, etc. .

(2) A brief introduction to new energy vehicle products, including an explanation of the principles of the new technologies and new structures adopted and relevant supporting materials.

(3) Parameters of "Vehicle Manufacturer and Product Announcement".

(4) "Registration Form of Main Technical Parameters and Main Configurations of Vehicles".

(5) "Compulsory Testing Project Plan for Vehicle Products".

(6) New energy vehicle product testing report issued by the testing agency.

(7) Enterprise standards or technical specifications for new energy vehicle products (including complete vehicles and power, drive, and control systems), as well as inspection specifications (including at least test methods, judgment criteria, inspection items, and prototype vehicles) Correspondence table, road conditions and mileage allocation, etc.).

(8) Other circumstances that need to be explained.

If the new energy vehicle product applied for belongs to the initial or development stage of technology, the following materials should also be submitted:

(1) After-sales service commitment (at least including product quality assurance commitment, after-sales service network construction, after-sales service commitment) Training of service personnel and product users, after-sales service items and content, provision of spare parts and quality assurance period, feedback on problems found during after-sales service, recycling of complete vehicles and parts (such as batteries), and claim handling, product quality, Response measures when serious problems arise in safety, environmental protection, etc.).

(2) A description of the intended sales area, and approval documents regarding the demonstration operation area and scope from the provincial industry and information technology department where the product will be used.

(3) An agreement signed with the intended user unit, including the vehicle operation and management regulations of the user unit and description of the usage quantity (only applicable to products in the initial stage). Enterprises that have obtained access to new energy vehicle enterprises shall submit the application materials required by Article 11 of these rules when the product category of the new energy vehicle product they apply for is different from the new energy vehicle product category that has been admitted.

When the technical solutions or technology sources of new energy vehicle products that have obtained access change, the enterprise shall re-apply for product access, submit the materials required by Article 12 of these rules, and explain the new application. The main differences between the product and the approved product. New energy vehicle companies that produce products in the initial and development stages should provide after-sales services to users in accordance with the content of after-sales service commitments; they should establish corresponding files for each vehicle and track the operation of the vehicle until the vehicle is stopped or scrapped. .

Enterprises that produce products in the initial stage should complete an annual demonstration operation report together with users and submit it to the Ministry of Industry and Information Technology. These rules will come into effect on July 1, 2009. After the implementation of these rules, if there is any inconsistency with these rules, these rules shall prevail.
