How will the battle between North and South Daoxiang Village be won?

On September 22, 2017, the Beijing Intellectual Property Court filed a dispute over trademark infringement and unfair competition between Beijing Daoxiangcun and Suzhou Daoxiangcun Food Co., Ltd. and Beijing Sudao Food Industry Co., Ltd. (collectively known as "Suzhou Daoxiangcun"). A conduct preservation ruling was made in the case: Suzhou Daoxiangcun immediately stopped selling and promoting pastries with the "Daoxiangcun" fan-shaped logo and "Daoxiangcun" logo on e-commerce platforms such as Yihaodian, Suning.com, Womai.com, JD.com, and Tmall Mall. and other products.

The Beijing Intellectual Property Court held that Suzhou Daoxiang Village’s alleged infringement on cakes, pastries, mooncakes, bread, biscuits, rice dumplings and other commodities may cause confusion and misunderstanding among the relevant public about the source of the commodities. Therefore, If Suzhou Daoxiang Village is not ordered to immediately stop the behavior involved in the case, it may have a serious impact on the market share of Beijing Daoxiang Village and cause irreparable damage to its interests.
