Regulations of Jilin Province on the Administration of Provincial Development Zones
Chapter I General Provisions Article 1 In order to further open wider to the outside world, speed up the construction of development zones, and realize the strategic goal of building a developed coastal province, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and the actual situation of our province. Article 2 The term "provincial development zones" as mentioned in these Regulations refers to specific areas established with the approval of the provincial people's government, which mainly develop export-oriented economy and processing industry and enjoy preferential policies. Article 3 These Regulations shall apply to the development, construction and management of provincial development zones. Article 4 The legitimate rights and interests of investors in the Development Zone are protected by the laws of People's Republic of China (PRC). All units and individuals in the Development Zone must abide by the laws, administrative regulations and local regulations of People's Republic of China (PRC). Article 5 The employees of enterprises and institutions in the Development Zone have the right to establish trade union organizations and carry out trade union activities according to law. Chapter II Management Article 6 The Development Zone Management Office established by the People's Government of Jilin Province is in charge of the work of provincial development zones in the province, and its main responsibilities are:

(a) to organize the preparation of the province's development zone development plan, and organize the implementation after the approval of the provincial people's government;

(two) development zone management regulations and preferential policies, implemented after the approval of the provincial people's government;

(three) to review the plans of major construction projects in the development zone and coordinate and solve the problems existing in the construction of the development zone projects;

(four) responsible for the demonstration and approval of provincial development zones;

(five) to coordinate the management and preferential policies of the relevant departments at the provincial level;

(six) in conjunction with urban construction, planning and other relevant departments to assist the development zone to do a good job in the preliminary work of construction projects and expand investment;

(seven) responsible for the training of management cadres in the development zone;

(eight) other functions and powers granted by the provincial people's government. Article 7 The Development Zone Management Committee (hereinafter referred to as the Management Committee) shall be established in the Development Zone to exercise unified leadership and management over the economic and administrative affairs of the Development Zone on behalf of the local people's government.

According to the needs of the development zone construction, upon approval, the administrative committee of the development zone may set up several functional departments to be responsible for the management of the development zone. Article 8 The Development Zone Management Committee shall exercise the following functions and powers:

(a) according to the laws, regulations and relevant provisions of the state, formulate measures for the implementation of the development zone;

(two) the preparation of the overall planning and economic and social development plan within the administrative area of the development zone, and organize the implementation after approval;

(three) according to the authority prescribed by the state and the province, examine and approve the investment projects in the development zone;

(four) responsible for the planning, requisition, development and management of land in the development zone;

(five) responsible for the development zone of finance, state-owned assets, taxation, labor and personnel and industrial and commercial administration;

(6) Planning, construction and management of infrastructure and public facilities in the Development Zone;

(seven) the establishment and management of the development zone culture, education, health, sports and other public utilities;

(eight) responsible for the environmental protection of the development zone;

(nine) according to the provisions of the state to deal with the foreign affairs of the development zone, and manage the import and export business of the development zone;

(ten) to coordinate the work of the branches of relevant departments in the development zone;

(eleven) to supervise the enterprises and institutions in the development zone according to law;

(twelve) responsible for the development zone social security and household registration approval management;

(thirteen) other functions and powers granted by the superior government. Article 9 The requisition, allocation and transfer of land within the planning area of the Development Zone must be included in the annual plan. Development zone construction land, people's governments at all levels should give priority to examination and approval. Article 10 The Development Zone shall create good operating and living conditions for domestic and foreign enterprises and other economic organizations or individuals, and provide infrastructure, service facilities and legal information consulting services such as water supply, power supply, drainage and communication. Eleventh financial, insurance, foreign exchange management and other departments can set up branches or agencies in the development zone to manage related affairs. Twelfth customs, commodity inspection and other departments may, according to the specific circumstances, set up supervision institutions or send supervisors in the development zone to carry out supervision and management. Chapter III Investment and Operation Article 13 The investment and operation of development zones may take the following forms:

(1) Sino-foreign joint ventures;

(2) Sino-foreign cooperative operation;

(3) foreign capital operation;

(4) Domestic enterprises and other economic organizations or individuals operate independently or jointly;

(5) Processing with supplied materials, processing with supplied samples, assembling with supplied parts and compensation trade;

(6) lease operation;

(seven) to buy bonds and stocks in the development zone;

(eight) energy, transportation and other infrastructure projects with large investment and long payback period, allowing foreign investors to operate in the form of construction, operation and transfer;

(nine) other ways permitted by the laws of People's Republic of China (PRC). Article 14 The Development Zone encourages the establishment of the following projects:

(1) Export processing industry;

(2) High-tech industries;

(3) products can replace imports;

(4) Basic industries such as energy and transportation;

(five) the tertiary industry with tourism, finance and trade as the focus. Fifteenth development zones prohibit the following projects:

(a) backward technology or outdated equipment;

(two) the discharge of pollutants exceeds the statutory standards;

(three) does not conform to the national industrial policy or economic development plan;

(4) It is forbidden by the state.
