Can I apply for a trademark on a product name?

Product names can be trademarked. If it is a specific name of a product, it can be registered as a trademark if it does not violate the provisions of the law.

If it is a common name of a product, it cannot be registered as a trademark if it only contains the common name; if in addition to the common name it also contains other distinctive signs that are easy to identify, you can apply for registration as a trademark.

Legal Basis

Article 11 of the "Trademark Law", the following signs shall not be registered as trademarks:

(1) Only the common name of the product, Graphics and models;

(2) Only directly represent the quality, main raw materials, functions, uses, weight, quantity and other characteristics of the goods;

(3) Other lack of significant Characteristic. If the signs listed in the preceding paragraph acquire distinctive features through use and are easy to identify, they may be registered as trademarks.
