When naming a trademark, you should pay attention to the following points:
1. A registered trademark must comply with the provisions of the Trademark Law
(1) If it is explicitly forbidden to be used as a trademark, it cannot be used, let alone registered: for example, official symbols that are identical or similar to the names, national flags, national emblems, military flags and medals of international organizations in China, foreign countries and intergovernmental organizations. In addition, copying, imitating and translating trademarks that are unregistered or registered by others in China cannot be registered or used.
(2) it is not allowed to register as a trademark: for example, the trademark lacks distinctiveness, or only the common name, figure, model, use and quantity of the commodity are not allowed to register as a trademark.
2. Trademark names should conform to the characteristics of the industry, enterprises and product positioning.
When naming a trademark, it must conform to the characteristics of the industry and the product positioning, and you can't blindly choose it according to your own preferences. For example, if the company deals in men's wear, you should proceed from the characteristics of men, and don't take some trademark names with the words "fairy, beautiful and beautiful".
3. The name of a registered trademark should be as short as possible, easy to address and easy to remember
When people see a trademark, they will have a short memory. If the name on it is too long and has no corresponding meaning, it will be difficult for them to remember. Chinese trademarks should be within four words as far as possible, and should not contain uncommon words. When naming, consumers should consider many factors such as brand names.
4. Don't be too close to the big names and trademarks of others.
If the Trademark Office is close to the trademarks of others or infringes on the prior rights and interests of the registered trademarks, it will fail the examination and reject them. Even if it can be registered under the certificate, it will easily lead to brand infringement disputes in the later stage. The purpose of establishing a brand is to distinguish other goods or services. If there is a dispute, not to mention whether the trademark can continue to be used, it will bring greater losses to the enterprise.
