Legal basis: Article 3 of the Regulations for the Implementation of the Trademark Law of People's Republic of China (PRC). If a trademark holder requests the protection of a well-known trademark in accordance with Article 13 of the Trademark Law, he shall submit evidence that his trademark constitutes a well-known trademark. The Trademark Office and the Trademark Review and Adjudication Board shall, according to the needs of examining and handling cases and the evidence materials submitted by the parties, identify well-known trademarks in accordance with the provisions of Article 14 of the Trademark Law.
