Indian trademark registration process:
1. Applicants for registered trademarks
An Indian trademark application can be a natural person or a legal person. As long as there is actual use or the idea of using a trademark in India, it can be applied, and the Indian trademark application also follows the principle of precedence. Enterprises or individuals in China can apply for trademarks in India with priority.
II. Materials to be prepared for registering a trademark
In applying for a trademark in India, you need to prepare a trademark application form in advance, a clear electronic trademark pattern of the trademark you are applying for, the classified name and description of the goods or services applying for a trademark, the time of initial use of the trademark, or a statement of intended use, the name, address and nationality of the applicant, and other relevant information. If you apply for trademark priority, you need to provide other relevant supporting documents with priority.
III. Detailed process of registering a trademark
1. Submit an application
Obtain the application contract and application number.
2. Apply for examination
According to the law, examine whether the trademark is registrable, whether it is the same as or similar to the previously registered trademark, and whether it violates the prohibition clause of the Trademark Law. For trademarks that fail to pass the examination, the examiner will notify the applicant in writing and inform the reasons for rejection. The applicant can submit a review within 3 months from the date of receiving the notice of rejection, otherwise, the application will be regarded as abandoned, and the application date and application number will not be retained. The applicant can apply for an extension on the condition of paying the extension fee. Trademark examiners may conditionally accept certain applications for trademark registration and may require the applicant to give up the right to use a certain character or figure in the trademark.
3. Publicity
After the trial, if there is no other objection, the Trademark Registration Office will issue A Letter f Acceptance (TLAOrder), and then the trademark will be publicized on the official trademark announcement. If no other person raises any objection within four months during the publicity period, the Trademark Registration Office will issue a registration certificate. Trademark registration is a tedious process, which takes about 24-36 months to complete the whole process. If the application is submitted successfully, the application number will be obtained immediately, and the priority will be counted from the date of application. Once the trademark is successfully registered, it will be valid for 1 years, counting from the date of submitting the application, and it can be updated indefinitely every 1 years after paying the relevant fees.
