1. What can be applied for as a trademark

1. Text, graphics, letters, numbers, three-dimensional logos and color combinations, and sounds can be applied as trademarks. If it is harmful to socialist morals or has other adverse effects, place names of administrative divisions at or above the county level or foreign place names known to the public shall not be used as trademarks, except where the place names have other meanings or are part of collective trademarks or certification marks.

2. Legal basis: Article 11 of the "Trademark Law of the People's Republic of China"

The following signs shall not be registered as trademarks:

(1) ) only the common name, graphics, and model of the product;

(2) only directly indicating the quality, main raw materials, functions, uses, weight, quantity, and other characteristics of the product;

(3) Others lacking distinctive features.

If the signs listed in the preceding paragraph acquire distinctive features through use and are easy to identify, they may be registered as trademarks.

2. What materials are required for trademark registration?

The materials required for trademark registration are as follows:

1. Application by a legal person or other organization, business license or legal person qualification Copies of certification documents from public institutions, associations and other organizations. Applicants outside the mainland area do not need such documents;

2. For foreign and Chinese natural persons, please provide a clear copy of your ID card. A copy of the individual industrial and commercial household license as a legal person; the business scope of the license must be consistent with the application scope;

3. The trademark pattern must be clear, clean, black and white, no larger than ten centimeters by ten centimeters, and no smaller than Five centimeters by five centimeters, in five copies;

4. For three-dimensional trademarks, a drawing that can determine the three-dimensional shape must be submitted;

5. For color trademarks, a text description must be submitted;< /p>

6. For collective trademarks and certification marks, subject qualification documents and usage management rules must be submitted;

7. "Trademark Agency Power of Attorney". If a trademark agency is entrusted to act as agent, it must be provided Power of attorney signed or stamped by the applicant. Applicants outside the mainland area who want to apply for trademark registration in China must entrust a trademark agency to act as their agent;

8. "Trademark Registration Application", if you entrust an agency to apply for registration, it will be prepared by the agency;

9. Special certification materials. If a portrait is used as a trademark, a letter of authorization from the portrait right holder notarized by a notary authority is required.
