1. Brief explanation

After the trademark is approved for registration, if the name, address or other registration matters of the trademark registrant change, the trademark registrant shall apply to the Trademark Office for the corresponding change procedures.

Since the implementation of the Trademark Law Implementation Regulations on September 15, 2002, trademarks that have been applied for but have not yet been approved for registration can also apply to the Trademark Office to change the name, address, and agent of the applicant. , or delete the specified products in the registration application.

If the exclusive right to use a trademark is transferred due to a business merger, merger or restructuring, the transfer procedures must be completed.

If the name of the trademark registrant is changed, the exclusive right to use the trademark will not be transferred.

2. Processing Channels

There are two channels for applying to change the name, address or other registration matters of the trademark registrant:

3. Changed document formats

There are four document formats for changes: "Application Form for Change of Name/Address of Trademark Applicant/Registrant", "Deletion of Products/ Service Project Application Form", "Application Form for Change of Trademark Agent", "Application Form for Correction of Trademark Application/Registration Matters".

The applicant should fill in the corresponding application form according to the specific matters being handled:

1. If it is necessary to change the name or address, the applicant should fill in the "Change of Name/Address of Trademark Applicant/Registrant" Application Form", if the trademark registrant or applicant applies to change the name and address at the same time, just fill in an application form;

2. It is necessary to delete the registered trademark or the goods or services in the registration application , the "Application Form for Deletion of Goods/Services" should be filled out, but the goods or services cannot be qualified or modified;

3. If the trademark agent needs to be changed, the "Change of Trademark Agent" should be filled out Application Form";

4. If you find that there are errors in the registration documents or application documents that need to be corrected, you should fill in the "Application Form for Correction of Trademark Application/Registration Matters". 4. Three steps for application

(1) Prepare application documents

The application documents that should be submitted are:

(1) Change application form (select the form according to the specific content of the application);

(2) Copy of the applicant’s identity document (copy of business license, ID card, etc.);

(3) If you entrust an agent to submit the "Agency Letter", if you apply directly in the acceptance hall, submit a copy of the handler's ID card;

(4) If you apply to change the name of the registrant, A change certificate issued by the registration authority should also be submitted;

(5) If the application documents are in a foreign language, a Chinese translation signed and sealed by a translation agency should also be provided.

2. When going through the change procedures, a change application form should be filled in for each trademark (each registration number) and stamped with the seal of the applicant and/or the seal of the agent.

3. If the applicant goes directly to the trademark registration hall, in addition to submitting the application, he must also submit the applicant's business license and a copy (or a copy of the business license with the official seal of the unit) and the business license. A copy of the applicant's ID card; if the applicant is a natural person and applies for the application in person, only a copy of the applicant's ID card is required. If you entrust a trademark agency to handle the matter, in addition to submitting the application, you must also submit a trademark agency power of attorney and a copy of the applicant's business license or ID card.

4. If you apply to change the name of the registrant, you must also submit a change certificate issued by the registration authority. If the registrant is an enterprise, a change certificate from the registration department of the industrial and commercial administration authority shall be issued; if the registrant is a public institution, a change certificate from the registration department of the public institution shall be issued; if the registrant is a natural person, a change certificate shall be issued from the police station where the registered residence is located.

The name before the change and the name after the change on the certificate should be consistent with the name before the change and the name of the applicant on the application form. If a foreign enterprise or foreigner only needs to change its Chinese translation name, a statement on the foreign enterprise or foreigner's application for changing its Chinese translation name should be provided.

5. For trademarks that have not been approved for registration, changes in the name of the applicant should also be handled in accordance with the above regulations.

6. If you apply for a change of address, you do not need to attach a change certificate, except for the case where a natural person changes his address across nationalities.

7. If a natural person changes his address across nationalities, he should submit proof that he has lived at the current address for more than one year when applying.

8. If the trademark applied for change is owned by ***, the following documents should also be submitted:

A. If *** has a trademark representative applying for change, fill in the change The application form for the name/address of the registrant should also submit a statement from other parties agreeing to the change.

B. Apply to change the *** trademark in the name of the owner, whether it is to change all the *** names or change part of the *** name, or change the *** trademark If you are a representative, you should fill in the names of all authorized persons on the application form. The name and address of the representative should be written on the first page of the application, and the names of other parties should be written on the attached pages of the application. If the representative’s name or address changes, the changed representative’s name and address should be written in the applicant’s name and applicant’s address columns on the first page of the application form, and the original name and address before the change should be written. (3) Pay the change fee

A change fee of 500 yuan should be paid for a change application.

If a trademark agency is entrusted to handle the application, the applicant shall pay the change fee and agency fee to the trademark agency. The change fee collected by the Trademark Office will be deducted from the advance payment of the trademark agency.

5. Notes

1. If the name or address of the trademark registrant is changed, the trademark registrant should change all registered trademarks at the same time.

2. After the change application is submitted, the Trademark Office that accepts the application will send the "Notification of Acceptance" to the applicant by mail according to the applicant's address filled in the application.

3. If the change application requires corrections, the Trademark Office will notify the applicant in writing by mail to make corrections within a time limit according to the applicant's address filled in the application form.

4. After the change application is approved, the Trademark Office will send the change certificate to the applicant by mail according to the address filled in the application form.

5. If the change application cannot be approved due to other reasons, the Trademark Office will notify the applicant in writing by mail according to the applicant’s address filled in the application form.

6. After the trademark change application is approved, the change certificate will only be issued to the representative. If anyone else needs it, they should apply for a reissue certificate.

7. If the applicant entrusts a trademark agency to handle the change application, the Trademark Office will not directly have any correspondence with the applicant, and all documents will be sent to the trademark agency.

8. The category of the application should be filled in according to the international classification category approved by the "Trademark Registration Certificate".
