2007 Work Report of the Supreme People’s Procuratorate

Dear Delegates:

Now, on behalf of the Supreme People’s Procuratorate, I report my work to the General Assembly, please review it, and invite the whole country to Members of the CPPCC expressed their opinions.

2006 is a year of great significance in the development of the People's Procuratorate. The Central Committee of the Communist Party of China made the "Decision on Further Strengthening the Work of the People's Courts and People's Procuratorates", which pointed out the direction for the procuratorial work under the new situation. The Supreme People's Procuratorate leads local People's Procuratorates at all levels and specialized People's Procuratorates to fully implement the Scientific Outlook on Development under the guidance of Deng Xiaoping Theory and the important thought of "Three Represents", conscientiously implement the Central Committee's "Decision" and the spirit of the Fourth Session of the Tenth National People's Congress, Various procuratorial work has made new progress.

1. Earnestly perform procuratorial duties and serve economic and social development

Focusing on the overall work of the party and the state, procuratorial organs across the country insist on establishing procuratorial work for the public and enforcing the law for the people, and deeply practice "strengthening the law" With the work theme of “supervising and safeguarding fairness and justice”, we will continue to work hard to increase the intensity of our work, improve the level of law enforcement and the quality of case handling, and strive to maintain social stability, ensure fairness and justice, promote social harmony, and create a good legal environment for economic and social development.

(1) Fight criminal crimes in accordance with the law. Adhering to the maintenance of stability as an important task, we actively participated in the comprehensive management of social security and safety construction, and conscientiously performed our duties of approving arrests and prosecutions. Throughout the year, we approved the arrest of 891,620 criminal suspects of various types and prosecuted 999,086 people.

Severely crack down on criminal crimes that seriously endanger social security in accordance with the law. Work closely with relevant departments to focus on combating organized crime, serious violent crimes, "two robberies and one theft" and other frequent crimes. The arrest of 47,228 suspects for intentional homicide, arson, explosion, rape, and kidnapping was approved, and 46,607 people were prosecuted; the arrest of 419,578 suspects for robbery, robbery, and theft was approved, and 445,849 people were prosecuted. In accordance with the unified deployment of the central government, we actively participated in the special struggle against organized crime and eradicated evil, intervened in investigation activities in a timely manner in major cases, approved the arrest of 18,446 criminal suspects of organized crime, prosecuted 8,343 people, and investigated and dealt with a number of state personnel acting as organized crime forces. The "protective umbrella" job-related crime cases have effectively combated crimes committed by evil forces.

Intensify efforts to crack down on crimes that disrupt market economic order and environmental resources. We severely punished crimes that seriously endanger economic security, disrupt market order, and damage people's lives and health. We approved the arrest of 24,211 suspects for crimes that disrupted market economic order, and prosecuted 27,728 people, a year-on-year increase of 14.2% and 11.1% respectively. Strengthening judicial protection of intellectual property rights and environmental resources, approving the arrest of 3,729 suspects in the production and sale of counterfeit goods and infringement of trademark rights, copyrights, and trade secrets, and filing 3,634 public prosecutions, a year-on-year increase of 16.7% and 12.6% respectively; approving arrests caused major There were 7,974 suspects in environmental pollution accidents, illegal mining and other crimes that damaged environmental resources, and 12,240 people were prosecuted, a year-on-year increase of 15.4% and 24.8% respectively. We continued to carry out special work to investigate and deal with crimes of dereliction of duty that undermined the market economic order, and initiated investigations into 295 state agency staff who were derelict in their duties during market supervision and who protected and indulged in economic violations and crimes.

Attach great importance to the handling of death penalty cases. In response to the situation that the power to approve death penalty cases has been centralized and exercised by the Supreme People's Court, and second-instance cases of death penalty cases are subject to court hearings in accordance with legal provisions, the Supreme People's Procuratorate issued a document emphasizing the need to effectively complete the arrest and prosecution of cases that may be sentenced to death in accordance with the law. Strictly control the facts, evidence, procedures and applicable laws, and strengthen legal supervision of the entire process of handling death penalty cases, including death penalty review, in accordance with the law to ensure the quality of case handling. At the same time, together with the Supreme People's Court, a judicial interpretation was formulated to regulate the trial procedures of second-instance death penalty cases. Since most places have not held court hearings for second-instance death penalty cases for a long time, the procuratorial organs do not have dedicated case-handling capabilities and staffing. Faced with a significant increase in workload, provincial procuratorates have taken measures such as temporary internal adjustments to case-handling forces and borrowing business backbones from lower-level procuratorates to ensure the smooth progress of the second-instance death penalty cases.

(2) In-depth investigation and prevention of occupational crimes.

We resolutely implemented the central government's overall deployment of the anti-corruption campaign and performed our duties in investigating and handling official crimes in accordance with the law. Throughout the year, we investigated 33,668 cases of official crimes involving corruption, bribery, dereliction of duty and infringement involving 40,041 persons. 24,448 cases involving 29,966 persons were investigated and prosecuted.

Resolutely investigate and handle major and important cases. Strengthen the organization and command of superior procuratorates in handling cases, strengthen collaboration and cooperation in cross-regional investigations, and improve the ability to discover and break through major and important cases. 18,241 major job-related crimes were investigated, including 623 cases of corruption and bribery exceeding one million yuan. A total of 2,736 state workers at or above the county or division level were investigated for suspected duty-related crimes, including 202 at the department or bureau level and 6 at the provincial or ministerial level. In conjunction with the public security organs, we launched a special operation to pursue fugitives and captured 1,670 fugitive suspects, an increase of 137.6% over the previous year.

Strictly investigate and handle cases that infringe on the vital interests of the people. 3,878 people from rural grassroots organizations were investigated for corruption and misappropriation of state funds to support agriculture, land acquisition compensation, poverty alleviation, disaster relief, relief and other funds, and 10,742 people from state-owned enterprises were involved in privately dividing, embezzling, misappropriating state-owned assets or selling the interests of state-owned enterprises. There were 930 state agency staff members who violated citizens’ personal and democratic rights by illegally detaining and extorting confessions through torture. For major safety production accidents, we simultaneously intervened in the investigation of the relevant competent (supervisory) departments, paid attention to discovering and investigating the job-related crimes behind the accidents, and opened cases to investigate 629 state agency staff who neglected their duties, condoned illegal production, and caused heavy losses. The Supreme People's Procuratorate has directly intervened in the investigation of eight major accidents, and has now opened cases for investigation of 50 state agency staff suspected of dereliction of duty and other crimes.

Actively participate in special work on combating commercial bribery. The Supreme People's Procuratorate conscientiously implements the central government's major decisions on combating commercial bribery, formulates work plans for the procuratorial organs in a timely manner, organizes and carries out special reporting and publicity nationwide, and establishes and improves case assistance investigation mechanisms and transfer acceptance mechanisms with relevant competent (supervisory) departments. Supervised the handling of 45 major typical cases, and directly directed the investigation and investigation of major cases such as bribery and serious dereliction of duty by relevant personnel of the State Food and Drug Administration during drug registration and approval. Procuratorates at all levels focus on engineering construction, land transfer, property rights transactions, pharmaceutical purchase and sale, government procurement, resource development and distribution, etc., actively investigate clues, dig deep into hidden cases, and comprehensively file and investigate commercial cases involving state workers. There were 9,582 bribery cases involving more than 1.5 billion yuan. A number of major commercial bribery cases involving a wide area, many people and large amounts of money were seriously investigated and dealt with, which deterred illegal crimes and curbed the spread of commercial bribery.

Based on the procuratorial function, we should do a good job in preventing occupational crimes. In conjunction with case handling, we strengthened the analysis of the causes and characteristics of typical cases and the crime trends in industries and fields prone to occupational crimes, and promptly recommended relevant departments to improve systems and plug loopholes. 13,662 procuratorial suggestions were made. We carried out case-based explanations and carried out more than 33,000 preventive warning educations, with more than 2.28 million people receiving education. Bribery criminal files were established in the fields of engineering construction, government procurement and other fields, and 7,319 inquiries were provided.

Strengthen international judicial cooperation in anti-corruption and bribery. The Supreme People's Procuratorate took the lead in establishing the International Federation of Anti-Corruption Authorities and hosted the first member representative conference. President Hu Jintao attended the conference and delivered an important speech. Representatives from 137 countries and regions attended the conference. The establishment of this international organization has established a new platform for my country to carry out international cooperation in anti-corruption.

(3) Strengthen legal supervision of litigation activities. Fully fulfill the legal supervision responsibilities for case filing, investigation, trial and penalty execution activities, highlight the key points of supervision, increase the intensity of supervision, and enhance the effectiveness of supervision.

Problems of lax supervision and enforcement of laws and ineffective crackdowns. For cases that should have been filed but were not, the investigation agencies were urged to file 16,662 cases. It was decided to arrest an additional 14,858 people and prosecute an additional 10,703 people who should have been arrested but had not been arrested or who should have been prosecuted but had not been transferred for prosecution. 2,846 people put forward corrective suggestions for illegal commutation, parole, or temporary execution outside prison. The Supreme People's Procuratorate organized special inspections in some areas to supervise and correct the problems of 6,074 criminals serving supervised release, and supervised the relevant departments on 207 criminals who no longer meet the conditions for supervised release. be placed in custody and executed.

Supervise the issue of infringement of the legitimate rights and interests of litigation participants in accordance with the law.

Investigating agencies were urged to withdraw 4,569 cases involving illegal use of criminal means to intervene in civil economic disputes and other cases that should not have been filed. We decided not to approve the arrest of 96,382 people who did not meet the arrest conditions; we decided not to prosecute 7,204 people who should not be held criminally responsible according to law or who had insufficient evidence. Provided 11,368 corrective opinions on illegal situations during investigation activities. We consolidated the results of centralized cleanup of overdue detentions, supervised and corrected 233 cases of overdue detention, and continued to maintain no overdue detention in the prosecution process. The Supreme People's Procuratorate, in conjunction with the Ministry of Public Security, organized a special inspection on arrests, conducting spot checks on more than 100,000 arrest cases handled in recent years, and rectifying problems such as excessive or strict arrest conditions and failure to promptly implement arrests after approval. and corrections, promoting the correct application of arrest measures in accordance with the law.

Conduct trial supervision in accordance with the law. We strengthened the supervision of cases where guilty verdicts were found not guilty, innocent verdicts were found guilty, and cases where the sentencing was too light or too severe, and 3,161 protests were made against criminal judgments and rulings that were believed to be erroneous; 2,200 corrections were made to illegal situations in criminal trial activities. We strengthened the supervision of civil trials and administrative litigation, promptly accepted and reviewed appeals from parties who were dissatisfied with the effective judgments of the people's courts, filed 12,669 civil and administrative protests, and put forward 5,949 procuratorial recommendations for retrials. For the 37,524 complaints that were not accepted by the correct judgment, we conscientiously did a good job in settling the complaints of the parties.

Strictly investigate and deal with duty-related crimes committed by judicial staff. Attention was paid to discovering clues to job-related crimes behind law enforcement and judicial injustice during the supervision of litigation activities, and the working mechanism for investigating job-related crimes by judicial staff was improved. 2,987 judicial staff were investigated for suspected abuse of power, bending the law for personal gain, soliciting and accepting bribes, and other crimes.

(4) Strengthen the work of prosecution, complaints, complaints and actively resolve conflicts and disputes. Starting from promoting social harmony, we put the resolution of social conflicts in a more prominent position in accordance with the law, and the *** handled 477,596 letters and visits from the masses in accordance with the law.

Further improve the petition work mechanism. The channels for interviews were opened up, and procuratorates at higher and lower levels were promoted to jointly receive visits, and the procuratorates at lower and lower levels were explored to carry out case visits and regular inspections. Throughout the year, they jointly received 739 petitioners for difficult cases, and received 27,283 people through visits and inspections. Adhere to the reception day system for the prosecutor general and improve the first office responsibility system. The accountability system was strictly implemented, and accountability investigations were conducted on petition cases involving law enforcement errors, and 63 persons were held accountable.

Seriously resolve the issue of letters and visits from the masses involving inspections. The "four determinations" and "two meetings" system were implemented to determine leaders, designated personnel, plans, and time limits. The complainants' opinions were listened to in person after the case was filed and closed, and 2,942 inspection-related petitions were properly handled in accordance with the law. The Supreme People's Procuratorate has dispatched 23 inspection teams to 17 provinces to directly supervise the handling of inspection-related petition cases. Problems reflected in the petition cases that were illegally seized and frozen by the procuratorate were rectified, and more than RMB 33 million in money and property was returned to the parties concerned. A comprehensive cleanup has been organized for 549 cases in which the procuratorial organs have made compensation decisions in recent years but have not yet been implemented, and 541 cases have been implemented so far.

Actively explore effective ways to do a good job in mass work in law enforcement and case handling. Many local procuratorial organs have implemented a question-answering and reasoning system in the work process such as not approving arrests and not prosecuting. While strengthening the rationality of legal documents, they patiently explain the law and reason in response to the questions and objections of the parties, and strive to convince people with law and reason. The case was handled in accordance with the law and conflicts and problems related to the case were resolved.

(5) Strengthen the standardization of law enforcement. Continue to deepen the special rectification activities of "standardizing law enforcement behavior and promoting fair law enforcement", insisting on improving law enforcement norms with one hand and implementing the system with the other. Targeting law enforcement positions and links that are prone to problems, the Supreme People's Procuratorate formulated and revised 33 normative documents such as quality standards for reviewing arrest cases, filing standards for dereliction of duty and infringement crimes, and regulations for seizing and freezing money and property. All localities focus on standardizing law enforcement behavior on the implementation of legal provisions and institutional norms, carry out level-by-level inspections and mutual inspections, promptly urge rectification of problems discovered, and strive to implement institutional norms in every grass-roots unit and every employee. Law enforcement positions and every aspect of case handling. Many local procuratorial organs have closely integrated standardized law enforcement with information management, actively promoted the construction of a "three-in-one" mechanism of business, team and information technology, and used computer networks to conduct process management, process control and dynamic supervision of law enforcement and case-handling activities, promoting strict Fair and civilized law enforcement.

Through hard work, the quality of case handling by the procuratorial organs has been further improved, with the prosecution rate and guilty verdict rate of job-related crime cases reaching 89.5% and 99.4% respectively.

Over the past year, the procuratorial organs have continuously enhanced their awareness of serving the overall situation in performing their duties. Following the opinions issued in previous years to serve the development of the western region and the revitalization of old industrial bases such as Northeast China, the Supreme People's Procuratorate has formulated opinions to serve the rise of the central region and the construction of a new socialist countryside. Procuratorates in various places actively explore ways and measures for service development, improve law enforcement methods, focus on law enforcement effectiveness, strive to create an environment conducive to reform and entrepreneurship, and promote economic and social development.

2. Promote procuratorial reform and ensure judicial fairness

Continue to conscientiously implement the central government’s arrangements for the reform of the judicial system and working mechanisms, and implement the three-year implementation of procuratorial reform formulated by the Supreme People’s Procuratorate in 2005 Opinions, adhere to the main line of strengthening legal supervision functions and strengthening supervision and restrictions on its own law enforcement activities, and further improve the procuratorial system and working mechanism.

(1) Improve the supervision mechanism for investigation and evidence collection activities. In response to the problems exposed in unjust cases discovered in recent years, the Supreme People's Procuratorate carefully analyzed the causes and summed up the lessons, and formulated the "Several Opinions on Strengthening Evidence Review in the Review of Arrests and Reviews of Prosecutions" to further improve the investigation of illegal crimes. behavior monitoring mechanism. It is emphasized that when handling criminal cases transferred by investigative agencies, more attention must be paid to the review of the legality of evidence, timely supervision and correction of illegal evidence collection, resolute exclusion of verbal evidence obtained through torture, and protection of innocent persons from criminal prosecution.

(2) Improve the connection mechanism between criminal justice and administrative law enforcement. In order to urge administrative law enforcement agencies to promptly transfer suspected criminal cases to judicial agencies and intensify the crackdown on criminal crimes, especially economic crimes, the Supreme People's Procuratorate, together with relevant departments, issued the "Opinions on Timely Transfer of Suspected Criminal Cases in Administrative Law Enforcement" , clarified the specific procedures for the procuratorial organs to supervise suspected criminal cases transferred by administrative law enforcement agencies, broadened the channels of supervision, and improved the means of supervision. In the past year, procuratorial organs across the country recommended that administrative law enforcement agencies transfer 857 suspected criminal cases, and investigated and dealt with 130 administrative law enforcement personnel who engaged in malpractice for personal gain and did not transfer criminal cases.

(3) Deepen the disclosure of inspection affairs. In order to better accept supervision from all walks of life and the people and promote justice through openness, the Supreme People's Procuratorate has formulated the "Opinions on Further Deepening the Disclosure of Procuratorial Affairs of the People's Procuratorates", adding 12 working systems that are disclosed to the society and litigation participants, In terms of case handling procedures and other aspects, we have improved the system for informing litigation participants of their rights and obligations, established press spokespersons in People’s Procuratorates at or above the provincial level, and established an accountability system for violations of procuratorial disclosure regulations, further enhancing the transparency of law enforcement.

(4) Continue to implement the system of synchronous audio and video recording of the entire interrogation process of suspects on duty. After establishing this system in 2005, the Supreme People's Procuratorate formulated two technical specifications last year to improve specific operating procedures. Currently, 2,171 procuratorates have implemented simultaneous audio and video recording, accounting for 59% of the total number of procuratorates nationwide. The implementation of this system has strengthened the supervision of the procuratorial organs' own law enforcement and case handling, played a positive role in preventing irregularities in interrogations and improving the level of investigation of occupational crimes.

(5) Promote the pilot system of people’s supervisors. At present, 86% of procuratorates across the country have carried out pilot work. Throughout the year, 5,191 duty-related crime cases were planned to be dismissed, handled without prosecution, or the suspects refused to accept the arrest decision, and entered the supervision process. Among them, the people's supervisors disagreed with the original opinions of the case handling department in 252 cases, and the procuratorial organs adopted 178 cases. , and explained to the People’s Supervisor the facts and laws that were not adopted. The scope of supervision by people's supervisors has been expanded, and specific supervision procedures have been stipulated for the "five situations" such as illegal searches and seizures. The role of the people's supervisor system in promoting fair law enforcement, ensuring the quality of case handling, and enhancing judicial democracy has further emerged.

3. Strengthen team building and improve overall quality

Adhere to fair law enforcement as the core and use the education of socialist rule of law concepts as the carrier to strengthen the ideological, organizational and disciplinary style construction of the procuratorial team .

(1) Carry out education on the concept of socialist rule of law. In accordance with the unified deployment of the Central Political and Legal Affairs Commission, procuratorial organs across the country have carried out education on the concept of socialist rule of law with the main content of "governing the country according to law, enforcing the law for the people, fairness and justice, serving the overall situation, and party leadership".

By organizing centralized training, carrying out learning activities from advanced models, using negative models to provide warning education, and analyzing wrong cases and cases of irregular law enforcement, prosecutors are guided to fully grasp the scientific connotation and essential requirements of the socialist rule of law concept, and from the perspective of law enforcement ideas, law enforcement In terms of concepts and law enforcement style, we should look for problems that are inconsistent with the requirements of the socialist rule of law concept, improve ideological understanding, and seriously carry out rectification. Through educational activities, some outstanding problems among the team were further solved, which led to the overall strengthening of the construction of the procuratorial team. Throughout the year, 1,104 groups and 2,110 individuals received commendations at or above the provincial level, and a number of advanced examples of fair law enforcement and law enforcement for the people emerged, such as Bai Jie and Ahemati Yiming.

(2) Strengthen the construction of leadership team and discipline and style. We will insist on making the construction of the leadership team a top priority and further strengthen the education, management and supervision of leading cadres. A rotational political training system was implemented, training more than 18,000 leading cadres at all levels. Establish and improve the reporting system for personal matters related to leading cadres and the system for reporting on their integrity, and strengthen supervision and inspection of the implementation of the "Six Strict Prohibitions". The Supreme People's Procuratorate sent personnel to inspect the leadership teams of 7 provincial-level courts, and 21 provincial-level courts carried out inspections of lower-level courts. In conjunction with the general election, we cooperated with the party committee in selecting the leadership team of the procuratorial organs, and conducted off-site exchanges with 662 prosecutors general. We strengthened the professional discipline and professional ethics education of prosecutors, piloted the procuratorial supervision system, improved the accountability system for law enforcement errors, and seriously investigated and dealt with 273 prosecutors who violated disciplines and laws, of which 27 were held criminally responsible.

(3) Promote the professionalization of the team. Efforts should be made to conscientiously implement the Prosecutor's Law, strictly enforce professional admissions for prosecutors, universally implement unified recruitment of new personnel and select prosecutors from those who have passed the judicial examination in accordance with the law, and continue to improve and promote the prosecutor selection system. Focusing on leading cadres and prosecutors on the front lines of law enforcement and case handling, we have strengthened formalized and classified training, carried out extensive on-the-job training, and trained more than 27,000 key business personnel in departments such as investigation supervision, public prosecutions, and occupational crime investigation. The undergraduate education of prosecutors in the western region has been strengthened, and the procuratorial organs in the eastern and central regions have been organized to provide counterpart support for procuratorial education and training in the western region. The Supreme People's Procuratorate has trained more than 500 key personnel in ethnic minority areas such as Tibet and Xinjiang.

(4) Continue to do a good job in the construction of grassroots procuratorates. We insisted on placing the focus of procuratorial work and team building on the grassroots level, implemented the "Outline for the Construction of the People's Procuratorates at the Grassroots Level", carried out in-depth activities to strive for advanced procuratorates, and selected and commended 200 national advanced grassroots procuratorates. Adhere to the system of superior procuratorate leaders contacting the grassroots and strive to do practical things for the grassroots. The Supreme People's Procuratorate sought the support of relevant departments and jointly issued opinions on alleviating the shortage of prosecutors in grassroots procuratorates in western and poverty-stricken areas, and replenished some staffing for grassroots procuratorates. 28 provincial procuratorates, together with the financial department, have introduced public funding guarantee standards for county-level procuratorates, further improving the grassroots funding guarantee mechanism.

Dear representatives, the achievements in procuratorial work over the past year have been achieved under the correct leadership of the Party Central Committee, under the leadership of party committees at all levels, and with the supervision and support of people's congresses, governments, political consultative conferences at all levels, and all sectors of society. The Standing Committee of the National People's Congress conducted an inspection of the implementation of the Prosecutorial Law and reviewed the report of the Supreme People's Procuratorate on the special rectification of procuratorial organs to standardize law enforcement behavior. The standing committees of local people's congresses at all levels have strengthened their supervision of procuratorial work by listening to special reports and organizing representative inspections. Deputies to the National People's Congress and members of the CPPCC National Committee at all levels put forward many good opinions and suggestions on procuratorial work, including 71 suggestions from deputies to the National People's Congress and 8 proposals from members of the National Committee of the Chinese People's Political Consultative Conference. Party committees and governments at all levels have implemented the "Decision of the Central Committee of the Communist Party of China on Further Strengthening the Work of the People's Courts and People's Procuratorates" and solved many difficulties and problems for the procuratorial organs. While summarizing the achievements, we are also clearly aware that there are still many gaps between the procuratorial work and the requirements of the party and the people. The main manifestations are: first, the role of legal supervision functions is not enough. Problems of weak supervision and inadequate performance of duties still exist in some places, and some issues of law enforcement and judicial injustice that have been strongly reported by the masses have not been effectively supervised and corrected. Second, legal supervision capabilities are not adapted to the requirements of building a harmonious socialist society. Some prosecutors have low levels of law enforcement, use simple methods of law enforcement, do not pay attention to resolving conflicts related to cases, and are not good at mass work, which affects the effectiveness of law enforcement. Third, problems of lax and irregular law enforcement still occur.

Some do not strictly enforce laws and case-handling systems, and do not pay attention to protecting the litigation rights of parties in accordance with the law. Some handle cases driven by interests, illegally seizing, freezing and disposing of the money and property involved in the case. Fourth, the discipline and style of the procuratorial team needs to be further strengthened. Some prosecutors have little awareness of enforcing the law for the people, and their enforcement is uncivilized and unfair. Some even violate the law and commit corruption and perversion of the law. Individual leading cadres seriously violated disciplines and laws, causing negative consequences. In addition, some local procuratorates have insufficient case-handling capabilities, and procuratorates in central and western regions and poor areas still face serious problems of funding shortages. Regarding these problems, the Supreme People's Procuratorate must further take effective measures, strengthen leadership and coordination, and conscientiously resolve them.

IV. Focusing on building a harmonious socialist society, do a good job in procuratorial work in 2007
