Article 2 Citizens, legal persons and other organizations engaged in the protection, management, development and utilization of ancient tea trees within the administrative areas of autonomous counties shall abide by these regulations. Article 3 The ancient tea trees mentioned in these regulations refer to wild tea trees, transitional tea trees, and cultivated tea trees that are more than one hundred years old and are distributed in the administrative areas of autonomous counties. Article 4 The people's government of the autonomous county shall protect scattered ancient tea trees by listing individual plants; delineate the protection and management scope of ancient tea mountains and areas where ancient tea trees are concentrated, and implement regional protection. The specific scope shall be demarcated by the autonomous county people's government and shall be included in the protection and management scope. Territorial spatial planning.

If the scope of protection and management involves nature reserves and forest parks, protection and management shall be carried out in accordance with relevant laws and regulations on the protection and management of nature reserves and forest parks. Article 5 The protection, management, development and utilization of ancient tea trees should adhere to the principles of priority protection, scientific management and rational utilization, and take into account the coordinated development of ecological, social and economic benefits. Article 6 The people's government of the autonomous county shall strengthen the protection, management, development and utilization of ancient tea trees, incorporate them into the local national economic and social development overall plan, include the required funds in the annual fiscal budget, and prepare relevant plans for the protection, management, development and utilization of ancient tea trees, according to The program will be implemented after approval.

The forestry and grassland administrative department of the autonomous county is responsible for the protection and management of ancient tea trees, and the agricultural and rural administrative department of the autonomous county is responsible for the development and utilization of ancient tea trees. Article 7 The responsibilities of the autonomous county forestry and grassland administrative department to protect and manage ancient tea trees are:

Main sources of funds:

(1) Funds arranged by county-level fiscal budget;

(2) Support funds from superiors;

(3) Social donations and other funds. Article 9: Autonomous counties shall establish a registration and protection list for ancient tea trees within their administrative regions and implement classified and hierarchical management. The people's government of the autonomous county should establish a traceability system for ancient tree tea products to achieve full traceability of ancient tree tea products. Article 11 The People's Government of the autonomous county encourages the joint development and utilization of ancient tea trees through joint ventures, cooperation, leasing, contracting, etc.

The valuation of ancient tea tree assets should be conducted by an appraisal agency with corresponding appraisal qualifications. The qualifications required by the assessment agency and the specific assessment methods shall be implemented in accordance with relevant national and provincial regulations.

Article 12 The People's Government of the autonomous county encourages and supports the following activities of developing and utilizing ancient tea trees:

(1) Using ancient tea tree germplasm resources to cultivate new tea varieties;

(2) Utilize the cultivated ancient tea tree resources in the county to develop specialty products;

(3) Establish an ancient tree tea information platform, develop an ancient tree tea brand with independent intellectual property rights, establish an enterprise tea quality and safety traceability system, and monitor ancient trees Implement information tracking on tea products;

(4) Carry out exchanges and cooperation on the utilization of ancient tea trees, explore the history and culture of ancient tea trees, and develop ancient tea tree cultural products and tourism products. Article 13 Within the scope of protection and management of ancient tea trees, the following behaviors are prohibited:

(1) Over-picking of ancient tea trees, etc. affects the growth of ancient tea trees and causes the growth and degradation of ancient tea trees;

( 2) Construction without approval, addition after approval, or unauthorized construction of buildings within the protection and management scope of ancient tea trees;

(3) Encroachment and destruction of ancient tea tree germplasm resources;

(4) Other behaviors prohibited by relevant laws and regulations.
