If a trademark is infringed, it is a crime of counterfeiting a registered trademark. You can report and complain to the industrial and commercial department.

Criminal Law Article 213: The crime of counterfeiting a registered trademark: Using the same trademark as the registered trademark on the same kind of goods without the permission of the owner of the registered trademark. If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not more than three years. Or criminal detention, and shall be concurrently or solely fined; if the circumstances are particularly serious, the offender shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years, and shall also be fined.

According to the provisions of the "Regulations for the Implementation of the Trademark Law", any person may complain or report any infringement of the exclusive right to use a registered trademark to the industrial and commercial administration department at or above the county level where the infringer is located or where the infringement occurred.

Complaints should generally be in writing, specifying the relevant circumstances and providing relevant evidence, such as the name and address of the suspected infringer, the place where the alleged infringement occurred, the allegedly infringing trademark logo or items (photos, photocopies )etc. At the same time, the complainant can also complain to the industrial and commercial administration department by phone.

Trademark infringement is very serious. It is best for merchants to choose a trademark monitoring agency in advance to avoid infringement incidents.
