China's Trademark Law follows the principle of voluntary registration and the rule of compulsory registration as an exception. Article 6 of the Trademark Law stipulates: "A commodity that must use a registered trademark as stipulated by the state must apply for trademark registration, and it shall not be sold in the market without approval." In other words, China needs compulsory registration for certain commodities. Article 4 of the Regulations for the Implementation of the Trademark Law: "The goods with registered trademarks as stipulated by the State in Article 6 of the Trademark Law refer to the goods with registered trademarks as stipulated by laws and administrative regulations." In our country, the goods that must use trademarks are tobacco products, and the law requires the compulsory use of registered trademarks for such goods. This is beneficial to the supervision of trademark registrants and defendants on the one hand, and to the strict management of special goods on the other. Article 47 of the Trademark Law stipulates: "Anyone who violates the provisions of Article 6 of this Law shall be ordered by the local administrative department for industry and commerce to apply for registration within a time limit and may also be fined." The provisions of this article are supplementary and concrete to the provisions of Article 6 of the Trademark Law on compulsory registration of trademarks. According to this article, the local administrative department for industry and commerce may exercise the power of administrative law enforcement and order a commodity that must use abuses to apply for registration within a prescribed time limit, prohibit its commodity from being sold in the market, stop advertising, seal up or confiscate its trademark logo, and may impose a fine according to the circumstances.
