Working Procedures for Recognition of Famous Trademarks in Zhejiang Province

General Provisions

In order to better reflect the principles of openness, fairness, impartiality and science and standardize the trademark recognition work in Zhejiang Province, according to the "Zhejiang Province Trademark Recognition and Protection Regulations" stipulate and develop this procedure. Article 2 The application, preliminary examination, review, recognition and announcement of trademarks shall be carried out in accordance with the procedures of these regulations.

Chapter 2 Application

Article 3: The Zhejiang Provincial Administration for Industry and Commerce will publish this year’s provincial trademark recognition announcement through the media. Enterprises, institutions, social groups, and individual industrial and commercial households established in accordance with the law in this province can download the Zhejiang Provincial Trademark from the portal website of the Zhejiang Provincial Administration for Industry and Commerce (/www.zjaic.gov.cn) or go to the local Administration for Industry and Commerce to obtain the "Zhejiang Provincial Trademark" Application form for tutoring.

Article 4 The Provincial Trademark Review and Adjudication Board Office (hereinafter referred to as the Review and Adjudication Board Office) is responsible for providing centralized coaching and training to applicants applying for trademarks across the province.

Article 5 If the applicant believes that his trademark meets the provincial trademark recognition conditions, he can download the "Zhejiang Provincial Trademark Recognition Application Form" from the Zhejiang Provincial Administration for Industry and Commerce portal or go to the local Administration for Industry and Commerce to obtain the "Zhejiang Provincial Trademark Recognition Application Form". Fill in the relevant content (application form in quadruplicate), formally apply to the city, county (district) Industrial and Commercial Administration Bureau, and provide the following application materials.

(1) Basic information: ① Overview of the applicant and enterprise development history; ② Enterprise size, assets, main economic indicators and development trends; ③ Production and operation of the main goods or services referred to by the trademark; ④ Product quality and market reputation, relevant public awareness, etc.; ⑤ Corporate integrity, environmental protection, corporate employment and social labor security, etc.; ⑥ Trademark registration, management, anti-counterfeiting rights protection, advertising, etc.

(2) Materials proving the legality of the subject.

1. Copy of corporate business license or other valid qualification certificate;

2. Copy of "Organization Code Certificate".

(3) Relevant materials proving the duration of use of the trademark.

1. "Trademark Registration Certificate" or a copy of the equivalent valid trademark registration certificate (with the seal of the local industrial and commercial administration department for confirmation) and trademark logo (5cmamp; times; 4cm in quadruplicate);

2. Proof that the trademark logo actually used on the goods is consistent with the trademark graphics, text, trademark use scope and trademark holder approved on the "Trademark Registration Certificate";

3. Documents proving the trademark’s early use and continuous use;

4. Documents proving the trademark’s foreign and overseas registration status.

(4) Relevant materials proving the publicity and promotion work of the trademark.

That is, the corporate product advertising and corporate image promotion related to the trademark, including promotional methods, geographical scope, types of promotional media, and advertising volume and other relevant materials;

(five ) Relevant materials proving the relevant public’s awareness of the trademark.

1. Relevant certification materials such as the production and sales ranking of the trademarked goods in the same industry;

2. Documents proving the distribution of the trademarked goods in domestic sales or service areas and exclusive sales outlets;

3. Documents certifying the export sales of goods marked with the trademark;

4. Relevant certification materials reflecting the public’s popularity, reputation and trust in the goods marked with the trademark.

(6) Relevant materials proving that the trademark is protected.

1. Documents proving the importance the enterprise attaches to trademark protection and the trademark management institutions, personnel and trademark management work;

2. The extent and scope of trademark counterfeiting and infringement and the protected Record relevant supporting materials.

(7) Other supporting materials proving the trademark.

1. Materials proving the changes in output, sales volume and sales revenue of the main products using the trademark in the past three years;

2. Profit of the main products using the trademark in the past three years , Materials proving changes in taxation;

3. Materials proving the foreign exchange earned by exporting the main commodities using the trademark;

4. The quality supervision and food hygiene of the commodities using the trademark Materials proving test conclusions in unified inspections, random inspections, regular and daily supervisory inspections organized by regulatory authorities (inspection-free products at or above the provincial level should provide inspection exemption certificates);

5. Trademark market reputation and awards at or above the provincial level;

6. It is a high-tech enterprise and provides valid certification materials.

(8) Relevant materials proving social responsibility in accordance with the law.

1. Strictly implement the relevant laws and regulations on labor and social security, and provide documentation proving that there have been no major labor disputes and other issues in the past three years;

2. Strictly implement the relevant laws and regulations on production safety , materials proving that no major production safety accidents have occurred in the past three years;

3. Strictly implement laws and regulations related to environmental protection, and materials proving that there have been no major environmental disputes in the past three years;

4. Strictly implement relevant laws and regulations on food hygiene management, and prove that no major food safety accidents have occurred in the past three years;

5. Documents that prove that there have been no major consumer rights disputes in the past three years.

(9) Other related materials.

Chapter 3 Acceptance and Preliminary Review

Article 6: Each county (city, district) industrial and commercial administration bureau is responsible for reviewing the authenticity of the applicant’s application materials, and those who are basically qualified for review , The units that plan to report should summarize and report to the Municipal Administration for Industry and Commerce on the basis of soliciting opinions from relevant departments. If the conditions are not met, the application materials will be returned and the reasons will be explained.

Article 7 The Municipal Administration for Industry and Commerce will review the application materials submitted by the county (city, district) Administration for Industry and Commerce within 30 days and make a preliminary decision. If the application meets the application conditions in the preliminary review, it will be reported to the Provincial Administration for Industry and Commerce in a bureau-issued document after deliberation and decision at the director's office meeting. Attached is a summary list and application materials of applicants bound into a volume. If the conditions are not met, the application materials will be returned and the reasons will be explained.

Article 8 If the applicant has objections to the preliminary review opinions of the municipal or county (district) industrial and commercial administration bureau, he or she may submit an application to the provincial industrial and commercial administration in accordance with Article 10 of the "Zhejiang Provincial Trademark Recognition and Protection Regulations" The Bureau filed an application for review. Applications for review must be made in writing, stating the reasons and providing relevant evidence.

Article 9. Trademark registrants who apply for renewal and confirmation of provincial trademarks (the last certification period expired for three years) can download the Zhejiang Provincial Administration for Industry and Commerce portal or go to the local Industry and Commerce Administration Bureau to obtain the "Zhejiang Provincial Administration for Industry and Commerce". "Trademark Continuation Confirmation Application Form" and submit it to the administrative bureau for industry and commerce of the county (city) under its jurisdiction. The county (city) Administration for Industry and Commerce shall submit the application to the Municipal Administration for Industry and Commerce after preliminary review, and the Municipal Administration for Industry and Commerce shall review and summarize the application and submit it to the Provincial Administration for Industry and Commerce.

Chapter 4 Review

Article 10 The Review Committee Office shall review the "Preliminary Review Recommendation Report" and the applicant's enterprise materials submitted by each municipal administration for industry and commerce, and shall be responsible for reporting to industry authorities and Industry associations solicit comments. And entrusted the Provincial Consumers Association to conduct a public survey. The results of the public survey and solicitation of opinions should be formed into written materials.

Article 11 The evaluation and recognition of trademarks in Zhejiang Province shall be carried out in accordance with the "Zhejiang Provincial Trademark Review and Adjudication Board Review Work Rules".

Article 12 Due to special circumstances such as trademark infringement and application, applicants who need to identify provincial trademarks may apply to the Municipal Administration for Industry and Commerce where the case occurs. The Provincial Administration for Industry and Commerce is responsible for investigation and review, and after soliciting the opinions of the Zhejiang Provincial Trademark Review and Adjudication Board in writing, it will make a determination and issue an announcement.

Chapter 5 Recognition Announcement

Article 13: Trademarks that have been confirmed and reviewed by the Zhejiang Provincial Trademark Review and Adjudication Board and the Provincial Administration for Industry and Commerce as having Zhejiang Provincial trademark qualifications and renewal confirmations shall be The Provincial Administration for Industry and Commerce issued the official document.

The Zhejiang Provincial Trademark Recognition and Extension Confirmation Announcement is published on the Zhejiang Provincial Administration for Industry and Commerce portal website and related media.

Chapter 6 Supplementary Provisions

Article 14 The Provincial Administration for Industry and Commerce is responsible for the interpretation of these working procedures.

Article 15 This working procedure shall be implemented from the date of announcement. The original "Zhejiang Province Trademark Recognition Work Procedures" will be abolished at the same time.
