Trademarks are designed by the company and applied for registration with the Trademark Office. It is a distinctive mark that distinguishes a company's products from other merchants. After the trademark is successfully registered, it must be used, otherwise others will apply for cancellation and lose the trademark rights. Next, the editor of Legal Express has compiled relevant content on how to use personal trademarks.
1. How to use personal trademarks
Personal trademarks are the same as corporate trademarks, and their use must comply with the provisions of the Trademark Law.
According to Article 49 of the Trademark Law of the People's Republic of China, a trademark registrant shall voluntarily change the registered trademark, the registrant's name, address or other registered trademarks during the use of the registered trademark. If the matter is not corrected within a time limit, the local administrative department shall order it to make corrections within a time limit; if the matter is not corrected within the time limit, the Trademark Office shall revoke the registered trademark.
Therefore, trademark use should be based on the correct use of the registered trademark on the registered goods. For example, if a registered trademark is a combination trademark, it cannot be used separately. Another example is word trademarks, whose arrangement cannot be changed at will. Other registration information such as the address and name of the trademark owner must not be changed at will and must be consistent with the information at the time of registration. If the registration items are changed, the changes should be made to the Trademark Office.
If a trademark is not used correctly, it may be deemed not to have been used, and anyone can apply to the Trademark Office for cancellation if it has not been used for three consecutive years.
