Is trademark registration necessary? Article 38 of the Trademark Law clearly stipulates that "using a trademark that is the same as or similar to its registered trademark on the same kind of goods or similar goods without the permission of a registered trademark shall be regarded as infringement of the exclusive right to use a registered trademark". In this way, if an enterprise does not register a trademark, there is the possibility that the registered trademark used on the same or similar goods is the same or similar, which is called infringement. Therefore, using an unregistered trademark, no matter what your intention is, there is always the possibility of infringing on the exclusive right of others to register a trademark.

Trademark registration process:

1, query whether the brand name and graphics are the same or similar in this category (very professional).

2. Preparation materials, a copy of the company's business license (individual industrial and commercial households) (individual industrial and commercial households need a copy of the legal person ID card).

3. After submitting the application materials, the Trademark Office will issue a national acceptance notice 15 within 30 days after receiving the application materials.

4. Wait for the Trademark Office to hear your trademark application.

5. After passing the preliminary examination, it will enter a three-month announcement period.

6. If there is no objection during the announcement period, it will automatically enter the approval announcement period of 1 month.

7. The certificate will be issued after the expiration of the examination and approval announcement, and the time you get it is usually about one month after the examination and approval announcement.

Trademarks can be registered by themselves or by agents. Generally, enterprises or individuals register through an agency. Individuals and enterprises don't know much about the process and details of registered trademarks, which easily leads to registration failure and rejection.
