According to Article 34 of the "Drug Administration Law of the People's Republic of China", drug marketing authorization holders can sell the drugs for which they have obtained drug registration certificates by themselves, or they can entrust drug operating enterprises to sell them. Drug marketing authorization holders who engage in drug retail activities must obtain a drug business license.

If a drug marketing authorization holder sells drugs on its own, it shall meet the conditions specified in Article 52 of this Law; if it sells drugs on an entrusted basis, it shall entrust a qualified pharmaceutical operating enterprise. The drug marketing authorization holder and the entrusted operating enterprise shall sign an entrustment agreement and strictly perform the obligations stipulated in the agreement.

Article 4 of the "Measures for the Administration of Drug Business Licenses", in accordance with Article 14 of the "Drug Administration Law", the establishment of a drug wholesale enterprise shall comply with the regulations of the province, autonomous region, Requirements for the rational layout of pharmaceutical wholesale enterprises in municipalities directly under the Central Government and meet the following establishment standards:

(1) Have rules and regulations to ensure the quality of the drugs they operate;

(2) Enterprises and their legal representatives The person or person in charge of the enterprise or the person in charge of quality management does not fall under the circumstances specified in Articles 75 and 82 of the Drug Administration Law;

(3) Having a certain number of practicing pharmacists commensurate with the scale of business operations. The person in charge of quality management must have a college degree or above and must be a licensed pharmacist;

(4) Have normal temperature warehouses, cool warehouses, and cold storage that can ensure the quality requirements for drug storage and are suitable for the variety and scale of its business. The warehouse has special shelves suitable for drug storage and devices and equipment to implement modern logistics systems for drug warehousing, transmission, sorting, shelving, and outbound delivery;

(5) It has an independent computer management information system, It can cover the entire process of the purchase, storage, sales, operation and quality control of drugs within the enterprise; it can comprehensively record information on enterprise management and implementation of the "Good Manufacturing Practice for Pharmaceutical Products"; it complies with the "Good Manufacturing Practice for Pharmaceutical Products" on pharmaceuticals. Requirements for all aspects of operation, and have the conditions to accept the supervision of the local food and drug supervision and administration department;

(6) Have pharmaceutical business premises and auxiliary and office buildings that comply with the "Pharmaceutical Goods Management Practice" As well as warehouse management, quality and safety assurance of drugs in the warehouse, and conditions for entry and exit, storage and maintenance in the warehouse.

If the state has other regulations on the operation of narcotic drugs, psychotropic drugs, toxic drugs for medical use, and preventive biological products, those regulations shall prevail.
