Regulations on the Prohibition of Trademarks:
1. Those that are identical with or similar to the national name, national flag, national emblem, military flag and medal of the People's Republic of China, and those that are identical with the names of specific places where central state organs are located or the names and figures of landmark buildings;
2. It is identical with or similar to a foreign country's name, national flag, national emblem and military flag, unless it is approved by the government of that country;
3. It is identical with or similar to the name, flag and emblem of an intergovernmental international organization, unless it is approved by the organization or is not easy to mislead the public;
4. It is identical with or similar to the official signs and inspection marks indicating the implementation of control and guarantee, unless it is authorized;
5. It is identical with or similar to the names and signs of the Red Cross and Red Crescent;
6, with ethnic discrimination;
7. Exaggerated propaganda and deceptive;
8. It is harmful to socialist morality or has other adverse effects.
Legal basis: Article 14 of the Trademark Law of the People's Republic of China
The following factors should be considered when identifying a well-known trademark:
(1) The awareness of the trademark by the relevant public;
(2) the duration of the use of the trademark;
(3) the duration, degree and geographical scope of any publicity work of the trademark;
(4) the record that the trademark is protected as a well-known trademark;
(5) Other factors that make the trademark well-known.
