Measures of Tianjin Municipality on the Identification and Protection of Famous Trademarks
article 1 in order to standardize the identification and protection of famous trademarks in Tianjin and protect the legitimate rights and interests of trademark owners, users and consumers, these measures are formulated in accordance with the provisions of the trademark law of the people's Republic of China and other relevant laws and regulations, combined with the actual situation of this municipality. Article 2 These Measures shall apply to the identification and protection of famous trademarks in Tianjin.

The term "Tianjin famous trademark" as mentioned in these Measures refers to a registered trademark that enjoys a high reputation in the market of this Municipality, is well known to the relevant public, and is recognized according to these Measures. Article 3 The identification and protection of famous trademarks in Tianjin shall follow the principles of voluntariness, openness, fairness and impartiality. Article 4 The administrative department for industry and commerce shall be responsible for the identification and protection of famous trademarks in Tianjin.

relevant departments such as development and reform, state-owned assets management, quality and technical supervision, and commerce should support the establishment and development of famous trademarks in Tianjin within the scope of their duties. Article 5 To apply for the recognition of a famous trademark in Tianjin, the following conditions shall be met:

(1) The trademark has been continuously used for three years since the date of approval and registration;

(2) the trademark has a high degree of credibility and awareness among the relevant public;

(3) having sound measures for the use, management and protection of trademarks;

(4) The main economic indicators such as output, sales, profit and market share of the goods using the trademark in the past three years rank among the top in the same industry in this Municipality;

(5) The products using the trademark have stable quality and high consumer satisfaction rate;

(6) other conditions stipulated by laws, regulations or rules that can prove that the trademark is famous. Article 6 Where the owner of a registered trademark resides in this Municipality, he shall apply to the local administration for industry and commerce for confirmation. If the domicile is not in this city, an application for confirmation shall be submitted to the municipal administrative department for industry and commerce. Article 7 when applying for accreditation, the following written materials shall be submitted:

(1) an application for accreditation;

(2) the applicant's qualification certificate and its copy;

(3) the trademark registration certificate and its copy;

(4) materials on the use and management of trademarks and the protection of the exclusive right to use trademarks;

(5) materials on the use and publicity of the trademark in recent 3 years;

(6) certification materials on the ranking of major economic indicators such as output, sales, profits and taxes, market share and so on of the goods using the trademark in the past three years in the same industry in this municipality;

(7) the quality certification materials of the goods using the trademark;

(8) the distribution of sales areas of goods using the trademark;

(9) survey materials on consumer satisfaction rate of goods using the trademark;

(1) other materials required by laws, regulations or rules.

the certification materials mentioned in item (6) of the preceding paragraph include the annual report of major economic indicators such as output, sales, profits and taxes issued by accounting firms, and the certification materials of market share and ranking in the same industry issued by relevant industry associations in the city. If there is no certificate issued by the relevant industry association, it shall issue statistical investigation materials and explain the way and scope of investigation and statistics. Article 8 the administrative department for industry and commerce shall, after receiving the application for accreditation and relevant written materials, examine it and deal with it according to the following circumstances:

(1) If the application materials are complete and conform to the legal form, it shall make a decision on acceptance within 5 working days from the date of receiving the application materials;

(2) If the application materials are incomplete or do not conform to the statutory form, the applicant shall be informed of all the contents that need to be corrected on the spot or within 5 working days; Fails to inform, since the date of receipt of the application materials shall be deemed to be accepted;

(3) if it is not within the scope of acceptance, it shall make a decision of rejection within 5 working days from the date of receiving the application materials.

if the application materials need to be corrected, the time for the applicant to resubmit all the corrected materials is the application time. If the applicant refuses to make corrections or fails to submit all the corrected materials, the administrative department for industry and commerce shall make a decision not to accept them.

if the applicant refuses to accept the decision, he may apply for administrative reconsideration or bring a suit in a people's court according to law. Article 9 After accepting the application materials, the branch administration for industry and commerce shall submit all the application materials to the municipal administrative department for industry and commerce within 3 working days from the date of acceptance. Tenth of the accepted application for identification, the municipal administrative department for Industry and Commerce shall publish a preliminary announcement in the city's public newspapers or the website of the municipal administrative department for Industry and Commerce, the publicity period is 3 days.

if the public raises objections during the publicity period, the municipal administrative department for industry and commerce shall investigate the contents of the objections and reply to the parties concerned in a timely manner. Article 11 The municipal administrative department for industry and commerce shall examine the accepted application materials in a timely manner, and invite relevant experts to participate when necessary. If it is necessary to verify the authenticity of the application materials, it may be entrusted to relevant institutions.

if the municipal administrative department for industry and commerce or its entrusted institutions seek opinions or investigate and verify the application for Tianjin famous trademarks from relevant industry associations, consumer rights protection organizations and other units, the relevant units shall cooperate. Article 12 The administrative department for industry and commerce shall properly keep the application materials of the applicant. If it is a trade secret, it shall be kept confidential. Thirteenth staff, experts, entrusted institutions and their staff who participate in the identification of famous trademarks in Tianjin shall withdraw if they have an interest in the applicant.
