What is the service trademark registration process?
The process of trademark registration must have the following stages: trademark inquiry, trademark application, formal examination, substantive examination, preliminary examination announcement and certification of registered trademarks. 1. Trademark inquiry: According to Article 28 of China's Trademark Law, if the trademark applied for registration does not conform to the relevant provisions of this Law or is the same as or similar to the trademark registered or preliminarily approved by others on the same or similar goods, the Trademark Office will reject the application and will not announce it. Therefore, before submitting an application for trademark registration, you must make a trademark inquiry to find out whether the trademark you have applied for is similar or identical, so as to reduce blindness and reduce the risk of trademark registration. 2. Trademark application: There are two ways to submit a trademark registration application: one is to go directly to the Trademark Office; The second is to entrust a nationally recognized trademark agency to act as an agent. 3. Formal review: The formal review of trademark registration refers to the review of the application, the description, clarity and necessary explanation of the trademark pattern, and the review of the goods/services reported after submitting the trademark application. An admission notice will be issued after passing the formal examination. 4. Substantive examination: Substantive examination refers to a series of activities such as examining whether a trademark complies with the legal provisions of the Trademark Law, conducting information retrieval, analysis and comparison, investigation and study, and deciding whether to grant preliminary approval or reject the application. 5. Announcement of preliminary examination: After examination by the Trademark Office, the trademarks that meet the requirements of the Trademark Law shall be announced for preliminary examination. If, within three months from the date of announcement, it is considered that the preliminarily approved trademark violates the relevant provisions of the Trademark Law, it may file an objection with the Trademark Office. 6. Identification of registered trademarks: If there is no objection to the trademark preliminarily examined and approved by the Trademark Office within three months from the date of announcement, it shall be approved for registration, issued with a trademark registration certificate and announced.
