1. Documents required for trademark registration
1. Register in the name of a company: copy of business license, trademark pattern
2. Register in the name of an individual: Copy of ID card, copy of individual business license (required), trademark pattern
3. Other applicants: Foreigners must provide a copy of their passport; Hong Kong, Macao and Taiwan residents must provide a valid identity document ( Passport, ID card, and return permit are all acceptable); Hong Kong companies need to provide company registration certificate and business registration certificate.
2. Trademark Registration Procedure
The procedure for applying for trademark registration is divided into three steps.
Step one: Query and analysis; ①Choose your own trademark (such as Chinese/English/graphic) and confirm which products or services you want to register it on (in order to avoid the trademark being similar to others and causing it to be trademarked) The trademark office rejected the application, and inquiry is an essential link)
②Our company determines the category of the product based on the name provided by the applicant, and then conducts an inquiry through the Trademark Office system. If it is found that there is an identical or similar trademark, our company will make a good suggestion based on the query; if it is found that there is no identical or similar trademark, the applicant can prepare for the trademark application.
Step 2: Determine the design of the trademark;
Step 3: Apply for registration.
① Application stage: Submit documents (before 4:30 p.m.) → Report to the Trademark Office on the same day → Get the Trademark Office acceptance receipt the next day;
② Formal acceptance and review stage: Formal review Pass → Trademark Office issues acceptance notice → Substantive examination;
③ Announcement and registration stage: Pass substantive examination → Preliminary examination announcement → Registration announcement → Trademark Office issues registration certificate.
After the formalities and documents are complete and submitted before 4 p.m., we will report it to the National Trademark Office on the same day. Since trademark registration in my country follows the first-to-file principle (please apply for a trademark as early as possible and keep it confidential to avoid being registered by others) ), the establishment of the application date is very important for the success of trademark registration. If someone else applies one day earlier, your creativity or huge investment in the brand in the early stage will be wasted.
3. Time for trademark registration
1. After entering the Trademark Office, it is divided into two parts: the first part is the formal review, which takes about 20 days. If the trademark passes the review, a "Trademark" will be issued. "Notice of Acceptance", and the relevant application information can be found on the China Trademark Network; the second part is to wait for the substantive examination, which takes about 6 months;
2. After passing the substantive examination, enter the preliminary examination announcement period , the announcement period is 3 months;
3. The approval period is 1 month, and the trademark certificate is issued.
