Chapter 1 General Provisions Article 1 In order to promote and ensure the sustainable development of the Shenzhen Special Economic Zone High-tech Industrial Park (hereinafter referred to as the High-tech Zone), standardize the management of the High-tech Zone, and provide a good legal environment for enterprises in the High-tech Zone and high-quality and efficient services. These regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and in combination with the actual conditions of the Shenzhen Special Economic Zone (hereinafter referred to as the Zone). Article 2 The term "high-tech zone" as mentioned in these Regulations refers to the park established in Shenzhen Bay by the Municipal People's Government and other economic areas delineated by the Municipal People's Government with the approval of the science and technology department of the State Council for the purpose of developing high-tech industries.
The High-tech Zone is planned and managed by the Municipal People's Government. Article 3 These regulations apply to organizations and individuals in the high-tech zone, as well as organizations and individuals outside the high-tech zone that engage in activities related to these regulations in the high-tech zone. Article 4 The development goal of the high-tech zone shall be to build a high-efficiency high-tech industrial base, a base for the incubation and radiation of scientific and technological achievements, and a training and education base for innovative talents.
The High-tech Zone focuses on the development of high-tech industries and other intelligence-intensive industries. Article 5: The High-tech Zone enjoys various preferential policies from the country, Guangdong Province and Shenzhen City to support the development of high-tech industries.
High-tech enterprises in high-tech zones can choose to apply the most favorable policies in the preceding paragraph based on the actual situation of the enterprise. Article 6: The assets, income and other property rights and other legitimate rights and interests of organizations and individuals invested in high-tech zones are protected by law, and no organization or individual may illegally occupy or commit other infringements.
Organizations and individuals may engage in activities in the Hi-tech Zone that are not expressly prohibited by laws, regulations and rules, except for behaviors that harm the interests of the public and violate social ethics. Article 7 The intellectual property rights of organizations and individuals in the High-tech Zone are protected by law and may not be infringed by any organization or individual.
Encourage enterprises, universities, scientific research institutions and related personnel in the high-tech zone to apply for patents, trademark registrations, and software copyrights, obtain independent intellectual property rights, and take protective measures for independent intellectual property rights. Chapter 2 Encouragement and Guarantees Section 1 Talent Introduction Article 8 Relevant municipal departments shall handle the "Talent Work Certificate" or relevant household registration procedures for the overseas students, scientific and technological and management talents from other provinces and cities introduced to the high-tech zone.
Personnel with a "Talent Work Permit" can enjoy the same treatment as residents registered in this city in terms of their children receiving compulsory education and purchasing housing. Article 9 Overseas students who are employed to hold professional and technical positions in high-tech zones are not subject to the restrictions of the employing unit’s indicators.
Students studying abroad who have obtained professional qualifications abroad and whose country has a mutual recognition agreement with my country can apply for the corresponding professional qualification certificate in this city. Article 10: The foreign affairs department will give priority to high-tech enterprises and institutions in high-tech zones who leave the country temporarily on official business to apply for long-term permits to Hong Kong and approval documents for overseas missions that are valid for multiple times a year. Section 2 Funding Support Article 11: Increase the support and funding of municipal fiscal science and technology funds and other special funds to improve the innovation system of high-tech zones and promote the development of innovation and entrepreneurship activities.
The High-tech Zone has established an international student entrepreneurship park. The Municipal People's Government invests in the establishment of entrepreneurial funding funds for returned overseas students, and arranges funds from the municipal fiscal science and technology funds to support returned overseas students to implement high-tech achievements, project transformation, and engage in research and development of high-tech projects.
The Shenzhen Virtual University Park has been established in the High-tech Zone, and the Municipal People's Government has arranged funds to support its development, providing office facilities and preferential scientific research, teaching, and living conditions to each university in the park. Article 12 The Municipal People's Government encourages enterprises, colleges and universities, and scientific research institutions to establish enterprises and institutions engaged in technological innovation in high-tech zones, or engage in research and development activities for technological innovation, and may provide financial support for their innovation activities. Article 13 The Municipal People's Government encourages enterprises, universities, scientific research institutions and other organizations or individuals to establish entrepreneurial service institutions (incubators) in high-tech zones to cultivate small businesses at the start-up stage or for partnership growth.
Entrepreneurship service organizations (incubators) can enjoy the city’s preferential policies to support high-tech industries. Article 14 The credit guarantee institution established by the Municipal People's Government shall provide credit guarantees, mainly financing guarantees, to small and medium-sized enterprises in the high-tech zones. Section 3 Risk Investment Article 15 Various domestic and foreign investment entities may carry out risk investment activities in the High-tech Zone.
Encourage domestic and foreign venture capital to establish venture capital institutions in high-tech zones.
Article 16 Venture capital institutions may take the form of limited partnerships.
The partners of a limited partnership are composed of limited partners and general partners. If the investor is a limited partner, he shall bear limited liability to the extent of his capital contribution; if the fund manager is a general partner, he shall bear unlimited liability.
Partners of a limited partnership shall sign a written contract. The partners' capital contribution proportions, distribution relationships, operating and management authority, and other rights and obligations shall be agreed upon by the partners in the contract.
The registration and management measures for limited partnerships shall be separately stipulated by the Municipal People's Government. Article 17: After the investment amount of venture capital institutions in high-tech enterprises in the high-tech zone reaches a certain proportion of the total investment amount, they can enjoy the preferential policies of the Municipal People's Government to support high-tech industries. The specific proportion shall be stipulated by the Municipal People's Government. Article 18 The Municipal People's Government encourages venture capital institutions to focus on investing in enterprises or projects that are in the start-up stage and have high-tech content and development prospects.
