Legal system of geographical indications
Since China joined the World Intellectual Property Organization (WIPO) on 1980 and the Paris Convention on 1985, our bureau has actively participated in the formulation and exchange of international laws on geographical indications, participated in the general meeting of WIPO members and the meeting of the Standing Committee on Laws on Trademarks, Industrial Designs and Geographical Indications every year, expressed opinions on the registration and protection of geographical indications on behalf of our government, and advocated in the field of international intellectual property rights.

In 2000, at the Sino-US Trademark and Copyright Seminar, the Trademark Office of our bureau and the US Patent and Trademark Office exchanged views on the protection standards of geographical indications in the TRIPS Agreement.

In the WTO negotiation between China and Mexico on 200 1, our bureau promised to protect the geographical indication products of Mexican tequila according to the laws of China.

In 2004, our bureau implemented the S2 project of Sino-European intellectual property cooperation (trademarks and geographical indications), and held an international seminar on geographical indications under this project.

In May 2005, our bureau and Australia jointly held the "Sino-Australian Geographical Indications Seminar" project.

On June 5438+065438+ 10, 2005, the Bureau and the World Intellectual Property Organization jointly held a "Regional Seminar on Strategic Use of Trademarks to Promote Economic and Rural Development" to exchange experiences in using trademarks and geographical indications of agricultural products to promote rural development, and at the same time held an exhibition on the achievements of geographical indications in China.

From June 5th to February, 2005, our bureau and the Ministry of Commerce of Thailand signed the Special Action Plan for Geographical Indications Activities between China and Thailand.

In May 2006, our bureau and the US Patent and Trademark Office jointly held a Sino-US seminar on the protection of geographical indications.

In June 2007, the Bureau and the World Intellectual Property Organization jointly held the "World Geographical Indications Conference" in Beijing. Wu Yi, then Vice Premier of the State Council, and Lu Biao, Special Envoy of the Director-General of the World Intellectual Property Organization, attended the meeting and delivered speeches. During the conference, an exhibition on achievements of geographical indications in China was also held. The World Intellectual Property Organization (WIPO) believes that this meeting fully shows that the China government is committed to strengthening and popularizing the intellectual property system, especially attaching importance to the protection of geographical indications.

At the end of June 2009, 5438+0 1, our bureau and the World Intellectual Property Organization jointly held the "International Symposium on Geographical Indications in Asia-Pacific Region" in Chongqing. Fu Shuangjian, deputy director of the State Administration for Industry and Commerce, and Wang Binying, deputy director general of the World Intellectual Property Organization, attended the meeting and delivered speeches. The purpose of this conference is to strengthen the international cooperation and exchange of geographical indications, and to explore the legal system of geographical indications, the registration, application and protection of geographical indications, and the successful experience of promoting rural economic and social development. During the conference and after the conference, China Geographical Indications Achievement Exhibition was held in Chongqing and Beijing respectively.

In addition, the Trademark Office of our bureau has sent delegations to Europe, the United States and Asian countries for many times to exchange experience in the protection system of geographical indications. Extensive international exchanges and cooperation have made the legal system and practice of protecting geographical indications in the form of trademark law known and appreciated by the international community.

Through more than 20 years of protection practice, China has successfully established and improved the legal system of protecting geographical indications with collective trademarks and certification trademarks, making geographical indications an important means for governments at all levels in China to help farmers increase their income and promote economic development. At the special historical moment when the overall implementation of the trademark strategy in China has achieved phased results, the Trademark Office has completely completed the task of trademark registration for three years to solve the backlog, and the number of geographical indications registered and initially approved trademarks has exceeded 1000, all the staff of the Trademark Office will continue to unify their thinking, clarify their tasks, strengthen their confidence, resolutely do a good job in the registration and protection of geographical indications in accordance with the trademark law, and make new and greater contributions to protecting the legitimate rights and interests of registrants, promoting the development of geographical indications, and actively serving the work of agriculture, rural areas and farmers!
