Personally, I think the meaning of counterfeiting a registered trademark in the Anti-Unfair Competition Law and the Trademark Law is the same. The main reasons are as follows:
Starting from the legal provisions, Article 2 1 of the Anti-Unfair Competition Law stipulates: "Let me make a hypothesis. For example, there is an operator who improperly uses the commercial reputation or commodity reputation of others, causing his own goods to be confused with those of others, making it impossible for consumers to distinguish the real producers or operators of goods or service providers (in short, an operator imitates the registered trademarks of others). At this time, how should we identify this behavior? Obviously, both the Anti-Unfair Competition Law and the Trademark Law have provisions on "counterfeiting registered trademarks", but according to Article 2 1 of the Anti-Unfair Competition Law, we actually apply the Trademark Law of People's Republic of China (PRC) and the Product Quality Law of People's Republic of China (PRC).
Now, we assume that the meaning of counterfeit registered trademarks is different in the anti-unfair competition law and the trademark law. Then, according to the previous series of presumptions, we can naturally infer that these two kinds of "counterfeit registered trademarks" with different connotations are handled in the same way. So, what is the significance of their differences and how are they established?
In fact, the provisions on counterfeiting registered trademarks in the Trademark Law are a kind of concrete or special law stipulated in the Anti-Unfair Competition Law, so it is natural to apply special provisions, that is, the provisions in the Trademark Law.
To sum up, I think the unfair competition means of counterfeiting registered trademarks in the anti-unfair competition law should belong to the field of intellectual property rights. Counterfeiting a registered trademark has the same meaning in the Anti-Unfair Competition Law and the Trademark Law, or it can be said that the same behavior is embodied in different laws!
