Article 1 According to the "Regulations on the Management of Natural Rubber in Xishuangbanna Dai Autonomous Prefecture, Yunnan Province" (hereinafter referred to as Regulations) and formulate these implementation measures.

Article 2 These Measures apply to units and individuals engaged in natural rubber planting, processing, operation, management and other activities within the administrative area of ??this state.

Article 3 The State People’s Government will support the natural rubber industry as a pillar industry, encourage and support the promotion of the planting of improved natural rubber varieties, the construction of ecological natural rubber gardens, the processing and production of special natural rubber primary products, and the deep processing of natural rubber. , promote quality control system certification.

Article 4: The state agricultural administrative department is responsible for the protection and management of the natural rubber industry throughout the state; the county (city) agricultural administrative department is responsible for the protection and management of the natural rubber industry within its own administrative region.

Agricultural rubber technology promotion agencies at all levels are responsible for the introduction, promotion, guidance and service of natural rubber technology within their respective jurisdictions.

Article 5 The main responsibilities of the agricultural administrative department in the protection and management of natural rubber are:

(1) Implement laws, regulations and policies related to the natural rubber industry, and Supervise and inspect the implementation;

(2) Formulate long-term development plans and policies and measures for the natural rubber industry, and organize their implementation after approval by the people's government;

(3) Responsible for the management of the natural rubber industry , guide and promote technical training and science and technology promotion of rubber, and coordinate the identification of professional skills in rubber production;

(4) Responsible for the management, use and supervision of rubber industry development support funds;

( 5) Organize and guide the construction of rubber information network and service system, collect relevant domestic and foreign science and technology and market information, and serve natural rubber production and product market circulation;

(6) Organize and implement the construction of rubber production early warning and forecasting system , guide, coordinate, inspect, and supervise the prevention and control of major rubber plant diseases and insect pests;

(7) Coordinate and guide rubber forest damage identification and compensation, rubber product processing enterprise layout planning and technological transformation, product quality testing, product marketing Circulation, production safety, environmental protection, industry association construction, rubber industry development, etc.

Article 6 The relevant administrative departments shall seek the opinions of the agricultural administrative departments at the same level when approving and evaluating natural rubber industry projects.

Article 7 The state agricultural administrative department, together with the state forestry administrative department, shall prepare an implementation plan for natural rubber ecological benefit compensation in accordance with national and provincial regulations on ecological benefit compensation, and submit it to the state people's government for approval before organizing its implementation.

Article 8 The state, county (city) people's governments encourage and support the establishment of natural rubber professional cooperative organizations and industry associations.

Natural rubber professional cooperative organizations and industry associations should play a coordination and self-discipline role, safeguard the interests of members and the industry, and accept the supervision and management of administrative departments.

Article 9: Gradually withdraw rubber forest from rubber forest in areas with fragile ecological environment and long-term economic and social development impacts, such as mountain steep slopes, as well as areas with severe land desertification and soil erosion.

Article 10 The development of natural rubber should adhere to the policy of “unified planning, continuous planting, large-scale operations, scientific management, and industrial upgrading”.

Article 11 The state agricultural administrative department shall formulate a state-wide natural rubber planting plan in accordance with the state-wide natural rubber development plan and organize its implementation.

Article 12 Natural rubber cultivation and management shall strictly implement the "Technical Regulations for Rubber Tree Cultivation" and "Technical Regulations for Rubber Tree Tapping" formulated by the Ministry of Agriculture and the "Implementation Rules for Technical Regulations for Rubber Tree Cultivation" formulated by the Yunnan Provincial Agricultural Reclamation Bureau 》.

Article 13 The county (city) agricultural administrative department shall establish a breeding and supply base for natural rubber improved seedlings based on the demand for seedlings. The standards for the construction of rubber tree seedling breeding and supply bases shall be implemented in accordance with the "Rubber Tree Seedling Production Base Standards" and the "Rubber Tree Seedlings National Standard" formulated by the Ministry of Agriculture.

Article 14: Applications for natural rubber seedling sales licenses shall be reviewed by the county (city) agricultural administrative department and then reported to the state agricultural administrative department for issuance.

The natural rubber seedling sales license is valid for 5 years; it cannot be transferred or loaned, but you can entrust others to sell natural rubber seedlings on your behalf.

Article 15 Anyone applying for a natural rubber seedling sales license must meet the following conditions:

(1) Registered capital of more than 2 million yuan and fixed assets of more than 1 million yuan;

(2) Have a business place suitable for the operation of seedlings;

(3) Have inspection equipment suitable for the operation of seeds;

( 4) Having full-time seed and seedling quality inspection and storage technicians;

(5) Other conditions stipulated by laws and regulations.

Article 16: The production and operation of natural rubber seedlings shall be subject to an origin quarantine system. Before leaving the nursery, natural rubber seedlings must undergo quality inspection and pest and disease quarantine, and relevant certificates of conformity must be issued by the agricultural administrative department.

Article 17: If a user of natural rubber seedlings suffers losses due to seedling quality problems, the operator selling the seedlings shall compensate the user, and the amount of compensation shall include the purchase price of the seedlings and related expenses.

Article 18 Those who produce natural rubber seedlings must strictly implement the technical operating procedures for seedling production prescribed by the state and breed high-quality natural rubber seedlings. Those operating natural rubber seedlings shall supply large-scale promotion level and medium-scale promotion level excellent varieties determined by the Yunnan Province Rubber Tree Variety Review; they shall not supply experimental seedling varieties to the market.

Article 19: The state agricultural administrative department shall formulate a state-wide natural rubber planting plan based on the state-wide overall natural rubber development plan, and submit it to the state people's government for approval before organizing its implementation.

The state agricultural administrative department should establish and improve the natural rubber planting standard system and promotion system; the county (city) agricultural administrative department should build a natural rubber standardized planting demonstration garden and promote the standardized planting and management of natural rubber gardens.

For new planting or renewal of natural rubber trees, standardized rubber gardens should be constructed in accordance with the requirements.

Article 20: To renew rubber forests, after submitting the application and plan to the agricultural administrative department, it shall be approved by the agricultural administrative department together with the forestry administrative department before implementation.

If the rubber forest area is more than 1,000 acres, it shall be approved by the state agricultural administrative department in conjunction with the state forestry administrative department; if it is less than 1,000 acres, the county (city) agricultural administrative department shall work together with the county (city) Approval from the forestry administrative department.

Article 21 The state, county (city) people's governments shall establish a joint mechanism for major rubber disaster monitoring, early warning and forecasting involving the development of biological industry, agriculture, reclamation, supply and marketing, meteorology, scientific research and other departments. Timely communication of information provides scientific basis for the effective prevention and control of rubber diseases, insects, cold, fire, wind, drought, hail, landslides, lightning and other disasters.

Article 22 Agricultural administrative departments and agricultural service agencies at all levels should strengthen early warning and forecasting of rubber diseases and insect pests, establish and improve private rubber disease and insect pest monitoring outlets, timely grasp the epidemic situation of diseases and insect pests, release information, and guide prevention and control , to improve the prevention and control effect; when a major disease or insect outbreak occurs, it should be reported to the local people's government and the higher-level agricultural administrative department in a timely manner, and an emergency plan for prevention and control should be initiated.

Article 23: The state agricultural administrative department shall work with relevant departments to formulate regulations on damage identification and compensation standards for rubber trees and production facilities, and shall submit them to the state people's government for approval before implementation.

Article 24: The state agricultural administrative department shall, in accordance with the principle of "integrating resources, integrating enterprises, improving quality and efficiency, and becoming bigger and stronger", formulate policies for natural rubber raw products, primary processing enterprises and deep processing enterprises. The enterprise layout plan shall be submitted to the state people's government for approval and then organized and implemented.

Article 25: If an enterprise that produces and operates natural rubber primary products changes or terminates, it shall go through the filing formalities with the local agricultural administrative department with relevant materials.

Article 26: Natural rubber product production and operation enterprises shall establish financial accounting systems and statistical reporting systems in accordance with relevant national regulations.

Article 27: The state agricultural administrative department is responsible for the management of acquisition licenses for natural rubber raw products, and strictly examines and approves them according to the processing site layout plan.

Applying for a natural rubber raw product acquisition license shall be reviewed by the county (city) agricultural administrative department and then reported to the state agricultural administrative department for issuance.

Article 28: Those who apply for a natural rubber raw product purchase license must meet the following conditions:

(1) Have a fixed raw product purchase station or point;

(2) Registered capital of more than 300,000 yuan;

(3) Have necessary quality testing equipment, storage and transportation tools and technical personnel;

(3) Have A letter of authorization from a rubber processing enterprise to purchase raw natural rubber products.

Article 29 A strict approval system shall be implemented for newly built, renovated and expanded primary natural rubber processing plants.

New construction, renovation and expansion of natural rubber primary processing plants must undergo an environmental impact assessment. If the environmental impact assessment is not passed, construction shall not begin.

Article 30 If the natural rubber processing wastewater, waste gas emissions and pollution treatment facilities do not meet the environmental protection requirements, the environmental protection administrative department shall order it to carry out treatment within a time limit. If it still fails to meet the standards after treatment, it shall be reported to the same department. It was forced to close after approval by the people's government at the next level.

Article 31 encourages primary natural rubber processing enterprises with technical equipment advantages, management experience, and financial strength to integrate primary processing enterprises with large resource consumption, poor product quality, and weak processing capabilities. , take the path of intensive, large-scale and standardized development.

Article 32: The state, county (city) people's governments encourage and support the construction of rubber deep processing projects, and provide support and preferential treatment in terms of approval, land supply, and factory construction.

Article 33: State, county (city) people's governments support scientific research institutions, colleges and universities, enterprises and individuals to research, develop and promote new technologies, new products and new processes.

Article 34: The state, county (city) people's governments encourage and support the construction of natural rubber brands and improve the visibility and comprehensive competitiveness of the natural rubber industry; those who have obtained China's well-known trademarks and Yunnan Province's famous trademarks will Give rewards.

Article 35 Anyone who violates the provisions of these Implementation Measures shall be punished by the agricultural administrative department in accordance with Article 26 of the Regulations.

Article 36 These Implementation Measures will come into effect on December 28, 2012.
