Article 28 of the Trademark Law:

Article 28: For a trademark applied for registration, the Trademark Office shall complete the review within nine months from the date of receipt of the trademark registration application documents. , if it complies with the relevant provisions of this Law, a preliminary review and announcement will be made.

This date means that the Trademark Office will complete the review within 9 months from the date of application. According to the current review speed of the Trademark Office, most trademarks can be reviewed in about 10 months. After reviewing the announcement, it will take more than a month.

Trademark applicants can check the trademark progress through China Trademark Online.

When the preliminary approval announcement date is displayed on the China Trademark Network, congratulations, it means that your trademark has passed the Trademark Office review. This is crucial for trademark registration. But don’t worry, we haven’t reached the stage of issuing a “Trademark Registration Certificate” yet.

Next, we should pay attention to the provisions of Article 33 of the Trademark Law:

Article 33: For a trademark that has been initially approved and announced, within three months from the date of announcement, the previous Rights holders and interested parties... may file objections with the Trademark Office. If there is no objection at the expiration of the announcement period, the registration will be approved, a trademark registration certificate will be issued, and the announcement will be made.

The provisions of this article are that after the preliminary review in Article 28 above, the announcement will be made, and the next step will be the announcement period. The announcement period is 3 months. According to Article 33 of the Trademark Law, within these three months, if a third party believes that the trademark has adverse effects, malicious registration, unauthorized agency, confusion of well-known trademarks, etc., it can file a trademark objection.
