Article 1: In order to respect the eating habits of the ethnic groups who eat halal food, strengthen halal food management, and standardize halal food production and operation activities, in accordance with the "Regional Ethnic Autonomy Law of the People's Republic of China" and in combination with the actual situation of the autonomous region , formulate these regulations. Article 2 Halal food as mentioned in these regulations refers to food, non-staple food and condiments that are produced, processed, stored, transported and sold (hereinafter referred to as production and operation) according to the dietary habits of the people who eat halal food. Article 3 Those engaged in the production, operation and supervision of halal food within the administrative area of ??the autonomous region must abide by these regulations. Article 4 The ethnic affairs departments of the people's governments at or above the county level are responsible for the supervision and management of halal food within their respective administrative regions.

The departments of industry and commerce, health, public security, economy and trade, quality and technical supervision, quarantine and other departments are responsible for the supervision and management of halal food in accordance with their respective responsibilities. Article 5 People's governments at all levels shall encourage and support the research and development of halal food with ethnic and local characteristics, and provide preferential treatment in terms of investment, taxation, credit, etc. in accordance with relevant national regulations. Article 6: Any unit or individual shall respect the eating habits of the people who eat halal food; any unit or individual has the right to report any violation of these regulations to the relevant competent authorities. Article 7 Enterprises and self-employed individuals who produce and operate halal food, in addition to meeting the food production and operation conditions stipulated in laws and regulations, must also meet the following conditions:

(1) Processing, storage, procurement, and sales Among the operators in major positions, there should be people from ethnic groups who have halal food eating habits;

(2) Have special equipment and facilities for processing, storing, transporting, and selling halal food. Article 8 Enterprises and self-employed individuals who produce and operate halal food should submit the following materials to the local county (city, district) ethnic affairs department to apply for a halal sign:

(1) Written application and personal information Proof of identity;

(2) Hygiene license and business license;

(3) Basic information of operators in major positions and supporting conditions of special halal food equipment and facilities.

If comprehensive shopping malls, supermarkets, bazaars, hotels, etc. that operate halal food need to display halal signs, they may apply for halal signs in accordance with the provisions of the preceding paragraph. Article 9 The ethnic affairs department of the people's government at or above the county level shall review the application within 10 working days from the date of receipt, and issue a liquidation sign to those who meet the conditions. Article 10: The style of halal signs shall be unified by the ethnic affairs administrative department of the autonomous region.

It is prohibited to transfer, lease, trade or use halal signs. Article 11 Enterprises and self-employed individuals who have obtained a halal sign shall hang the halal sign in a conspicuous position of their production and business premises, and the word "halal" shall be prominently displayed on their trade names, signboards, and the names and packaging of food.

Foods that do not contain meat, dairy and edible oil ingredients are not allowed to be labeled "halal". Non-halal food must not be packaged in packaging with a halal logo. Non-halal food must not be passed off as halal food. Article 12 Enterprises and self-employed individuals who produce and operate halal food shall not contain any language, characters, symbols, patterns or combinations of which are taboo for the ethnic groups that eat halal food, as well as their name, packaging and advertisements. Article 13: Stalls and counters for food or items that are taboo for ethnic groups with halal food eating habits set up in comprehensively operated shopping malls, supermarkets, bazaars, hotels, etc. shall be kept at an appropriate distance from the stalls and counters of halal food, or be separated from them. facility. Article 14 Enterprises and self-employed individuals who produce and operate halal food must return the halal sign to the department that originally issued the halal sign before suspending or relocating their business. Article 15 Enterprises and individual producers and operators that have obtained halal signs shall not produce or trade non-halal food. Article 16 If an agency, group, enterprise or institution has an internal halal canteen, its purchasing, storage and cooking personnel should include people from ethnic groups with halal food habits, warehouses, cooking tools, measuring instruments, food transportation vehicles and production sites. Must be dedicated.

Article 17 For any food sold as halal food that enters the territory of the autonomous region, its operators must hold a "halal" certificate issued by the ethnic affairs department of the people's government at or above the county level where the food is produced. Article 18 The competent departments for ethnic affairs of the people's governments at or above the county level shall strengthen supervision and inspection of enterprises and self-employed individuals who produce and operate halal food within their respective administrative regions, as well as halal canteens in shopping malls, supermarkets, bazaars, hotels, and units. Article 19 Anyone who violates the provisions of these Regulations and engages in production and business operations by hanging halal signs or marking the word "halal" without obtaining halal signs will be ordered to make corrections by the ethnic affairs department of the people's government at or above the county level. If he refuses to make corrections, A fine of not less than 500 yuan but not more than 2,000 yuan will be imposed. Article 20 Whoever violates the provisions of these Regulations by transferring, leasing, buying and selling, or using falsely the halal signs shall have the halal signs revoked by the ethnic affairs department of the people's government at or above the county level, the illegal gains shall be confiscated, and a fine of not less than 500 yuan but not more than 5,000 yuan shall be imposed. . Article 21 Anyone who violates the provisions of these Regulations and commits any of the following acts shall be given a warning by the ethnic affairs department of the people's government at or above the county level and ordered to make corrections within a time limit; if the correction is not made within the time limit, a fine of not less than RMB 1,000 but not more than RMB 5,000 shall be imposed:

(1) Foods that do not contain meat, dairy and edible oil ingredients are labeled with the word "halal";

(2) Use packaging with a halal logo to package non-food products Halal food;

(3) Passing off non-halal food as halal food;

(4) Producers and traders who have obtained halal signs produce and trade non-halal food.
