Interim Measures for the Administration of Provincial Government Procurement Online Shopping Mall in Shandong Province
Chapter I General Provisions
Article 1 In order to standardize the procurement behavior of government procurement online shopping malls (hereinafter referred to as online shopping malls), improve procurement efficiency and enhance procurement transparency, these Measures are formulated in accordance with the "People's Republic of China Procurement Law" and its implementing regulations, and in combination with the actual procurement of provincial governments.
article 2 these measures shall apply to the online shopping mall procurement activities carried out by provincial state organs, institutions and organizations in Shandong province (hereinafter referred to as purchasers) with financial funds.
article 3 the term "online mall" as mentioned in these measures refers to a service platform that relies on the internet to realize the online transaction and supervision of small general goods, projects and services.
The information of the provincial online shopping mall platform is open, and the resources are shared, and cities are encouraged to use it.
article 4 the procurement activities of online shopping malls shall follow the principles of openness, transparency, convenience and efficiency, honesty and credibility, and compliance with laws and regulations.
Article 5 The Provincial Department of Finance is the supervision and management department of online shopping malls, which is responsible for formulating online shopping mall management rules and regulations, supervising provincial online shopping mall procurement activities and parties concerned according to law, and coordinating and guiding online shopping mall procurement in the province.
article 6 the procurement center of Shandong provincial people's government (hereinafter referred to as the "provincial procurement center") is the construction and operation organization of the online shopping mall platform system. Including the construction of a unified online shopping mall trading platform, the formulation of trading rules and procedures, the organization and management of supplier warehouses and commodity warehouses, the establishment of price monitoring and credit evaluation mechanisms, the coordination and handling of trading disputes, and the supervision of performance.
article 7 the catalogue and quota standard of online shopping malls shall be formulated by the provincial department of finance, which shall implement dynamic management. under normal circumstances, it shall be promulgated and implemented together with the catalogue of centralized government procurement.
article 8 the procurement activities of online shopping malls shall strictly implement the asset allocation standards of provincial administrative institutions, implement the functions of government procurement policies such as promoting energy conservation and environmental protection, purchasing domestic goods and supporting the development of small and medium-sized enterprises, and support the realization of economic and social development goals.
article 9 the developer and operator of the online mall platform system shall not charge any fees from the purchasers, suppliers, financial departments of cities and counties, purchasers and centralized purchasing agencies that use the online mall platform system.
chapter ii supplier management
article 1 the supplier of online shopping malls is subject to the access system, and the provincial procurement center shall be produced by means of public solicitation and commitment to settle in according to the principle of "compliance with laws, openness and transparency, and fair competition". The provincial procurement center shall formulate detailed rules for the management of suppliers of online shopping malls.
Article 11 A supplier who participates in the establishment of an online shopping mall shall meet the following conditions:
(1) Having the ability to bear civil liabilities independently;
(2) It has a good business reputation and a sound financial accounting system;
(3) having the necessary equipment and professional technical ability to perform the contract;
(4) having a good record of paying taxes and social security funds according to law;
(5) There is no record of serious violation of laws in business activities within three years before participating in government procurement activities;
(6) Other conditions stipulated by laws and administrative regulations.
article 12 after a supplier has settled in, he/she shall register in the supplier database of the online shopping mall, and the registered information shall be true and valid, and shall be made public.
article 13 online mall suppliers are composed of e-commerce, manufacturers, agents and designated suppliers.
E-commerce refers to a supplier who sells goods or provides services to the society through e-commerce platforms and information networks such as the Internet. E-commerce should be approved by the relevant industry authorities and have the qualification to engage in value-added telecommunications business.
a manufacturer refers to a supplier who manufactures goods that meet the requirements of national or industrial standards.
an agent refers to a supplier whose products are manufactured by a sales manufacturer and put on shelves in this mall.
a designated supplier refers to a supplier who provides customized products, services or construction according to the requirements of the country or industry and the requirements of the purchaser.
article 14 the settled supplier shall sign an online mall settlement agreement, fulfill corresponding obligations and assume corresponding responsibilities in accordance with the requirements for the entry of online mall categories and procurement regulations.
article 15 the entry agreement is valid within the specified time. when the agreement expires, the provincial procurement center shall, according to the implementation of the agreement, reorganize the entry or renew the entry agreement to determine the entry suppliers.
