Chapter 1 General Provisions
Article 1 is to further promote the expansion of consumer demand, improve resource and energy utilization efficiency, and reduce environmental pollution pollution, promote energy conservation, emission reduction and the development of circular economy, according to the "Letter from the Ministry of Commerce and the Ministry of Finance and the Ministry of Environmental Protection on Issuing the Work Plan for the Promotion of Trade-In Promotion of Home Appliances" (Shangshangmaofa [2010] No. 190) and the "Industrial Development and Reform Commission of the Ministry of Commerce and Finance" The Ministry of Information Technology, the Ministry of Environmental Protection, the State Administration for Industry and Commerce, the General Administration of Quality Supervision, Inspection and Quarantine issued the Implementation Measures for the Trade-in of Old Home Appliances (Shangmaofa [2010] No. 231), and formulated these implementation rules based on the actual situation of our region. Article 2 The term “trade-in of old home appliances for new ones” as mentioned in these Measures refers to the behavior of consumers selling old home appliances and purchasing new ones. Article 3 The promotion and implementation period of the home appliance trade-in policy is tentatively scheduled from September 10, 2010 to December 31, 2011. During this period, we will do a good job in coordinating with the policy of establishing a waste electrical and electronic product processing fund from 2011 as stipulated in the "Regulations on the Management of Recycling and Disposal of Waste Electrical and Electronic Products" (State Council Order No. 551). Article 4 The replacement of old home appliances with new ones follows the principles of “simple procedures, direct subsidies, safety and efficiency, energy conservation and environmental protection”. Chapter 2 Subsidy Policy Article 5 Subsidy Methods and Objects: 1. 2. The winning bidder of home appliance recycling companies (hereinafter referred to as recycling companies) that purchase old home appliances from buyers and sell them to designated dismantling companies for dismantling and processing during the policy implementation period can enjoy freight subsidies. . 3. Dismantling and processing companies that have completed dismantling of used home appliances sold by buyers during the policy implementation period can enjoy dismantling and processing subsidies. 4. During the policy implementation period, if individuals purchase new home appliances, the total quantity shall not exceed 5 units; if units purchase new home appliances, the total quantity shall not exceed 50 units. The purchase of new home appliances is not subject to restrictions on the types of old home appliances sold. Article 6 The scope of home appliance products subsidized for trade-in: televisions, refrigerators (including freezers), washing machines, air conditioners, and computers.
Article 7 Subsidy standards are: 1. Home appliance subsidies. Units or individuals that sell old home appliances and purchase new home appliances will be given a subsidy of 10% of the sales price of the old home appliances for new ones after being reviewed by the home appliances trade-in winning bidder sales enterprise and complying with the policy provisions. The upper limit of the subsidy is: 400 yuan per TV set, Refrigerator (including freezer) is 300 yuan/unit, washing machine is 250 yuan/unit, air conditioner is 350 yuan/unit, and computer is 400 yuan/unit. 2. Freight subsidy. If the home appliance recycling company that wins the bid purchases old home appliances and sells them to designated home appliance dismantling and processing companies during the policy implementation period, it can enjoy freight subsidies. Freight subsidy is implemented at a fixed amount according to the type, specification and transportation distance of recycled old home appliances. (See Appendix 1 for specific subsidy standards). For home appliances that are determined by the bidding (including the Corps) in Xinjiang (including the Corps), the old recycling enterprise with the old replacement of the old replacement will be implemented in accordance with the "Supplementary Notice of the Home Appliances on the New Freight of the Household Appliances" (Cai Jian [2010] No. 44) documents; The relevant provisions of the "Measures for Freight Subsidy for Trade-in of Home Appliances" (Cai Jian [2009] No. 498) shall be implemented.
3. Dismantling and disposal subsidies: When dismantling and processing enterprises purchase old home appliances during the policy implementation period, a settlement period of 30 working days will be given, and a fixed subsidy will be given in each settlement period based on the actual dismantled quantity. The specific subsidy standards are: TV set 15 yuan/set, refrigerator (including freezer) 20 yuan/set, washing machine 5 yuan/set, computer 15 yuan/set; air conditioners are not subsidized.
Article 8. New home appliances that are exchanged for new ones must comply with relevant national safety, environmental protection and other standards.
Chapter 3 Operational Procedures
Article 9 Home appliance sales enterprises and recycling enterprises shall be determined by the Autonomous Region Department of Commerce and the Xinjiang Xinjiang Xinjiang Xinjiang Xinjiang Xinjiang Autonomous Region’s Commerce Bureau in conjunction with the Xinjiang Autonomous Region Finance Department and Xinjiang Xinjiang Xinjiang Xinjiang Xinjiang Xinjiang Xinjiang Xinxing Bureau’s Finance Bureau through bidding. The dismantling and processing enterprises shall be determined by the Autonomous Region Environmental Protection Bureau. The results of the bidding and environmental assessment will be reported to the Ministry of Commerce, the Ministry of Finance, and the Ministry of Environmental Protection for filing, and the list and contact information of the successful bidders for home appliance sales and recycling will be announced to the public.
Article 10: The buyer chooses a recycling enterprise. The buyer voluntarily chooses to recycle first and then buy or buy first and then recycle, and submits an application for the sale of old home appliances through the Internet, telephone and other methods, and the recycling enterprise will come to the door in a timely manner. Purchasing old home appliances; or the buyer purchases new home appliances first, and the home appliance sales company that wins the bid will recycle the old home appliances while delivering the new home appliances to the purchaser. For those who meet the conditions, the home appliance sales company will collect relevant information from the purchaser in a timely manner and honor the purchaser's obligations. Enjoy the subsidy funds, complete the advance payment of the subsidy funds, and replace the home appliance sales invoices with the home appliance trade-in certificates uniformly formulated by the state. No unit or individual may transfer or sell home appliance trade-in certificates to obtain financial subsidies. Recycling companies must promptly and accurately provide all the information on the home appliance trade-in voucher, including the category, brand, product manufacturer, model, body serial number of the recycled old home appliance, the name and ID number of the purchaser, the recycling price of the old home appliance, and the trade-in voucher sequence. The number, etc. are entered into the home appliance trade-in management information system, and the body serial number generated by the system is pasted on the old home appliance that does not have a body serial number. Article 11 The main components of recycled old home appliances must be complete and must be sold strictly in accordance with the standards in Appendix 3 of these rules. Otherwise, the recycling or dismantling company may reject them depending on the circumstances. (See Attachment 2) Article 12 The buyer chooses the successful bidder and goes to the home appliance sales enterprise to purchase new home appliances with a valid identity document and a home appliance trade-in certificate. For those who meet the conditions, home appliance sales companies will directly advance subsidy funds to buyers when selling new home appliances, and enter relevant information into the home appliance trade-in management information system. Article 13 All used household appliances purchased by recycling companies will be sold to designated dismantling and processing companies for dismantling and processing. For those who meet the conditions, the dismantling and processing company will advance transportation cost subsidies to the recycling company and enter the relevant information into the home appliance trade-in management information system. Article 14 Home appliance sales enterprises shall submit new home appliance sales invoices, trade-in vouchers, and "Home Appliance Trade-in (Home Appliances) Subsidy Fund Declaration Form" and other materials to the financial (service) department at the same level after being reviewed by the commercial authorities of each city, county, and group market. Article 16: With reference to the recycling and dismantling prices of old home appliances in the nine pilot provinces and cities that implement the trade-in of home appliances, and in light of the actual conditions in Xinjiang, the recycling and dismantling prices of old home appliances in our district are formulated (see Appendix 2) Chapter 4 Article 17 of Home Appliance Recycling Enterprises In order to facilitate buyers to hand over and sell old home appliances, the recycling of old home appliances adopts diversified recycling methods. Home appliance manufacturing companies (after-sales service agencies), sales companies, professional recycling companies, etc. can participate in the bidding activities for home appliance trade-in recycling companies organized by the Autonomous Region Department of Commerce and other relevant departments. Article 18 The home appliance recycling enterprise determined through bidding shall have corresponding service capabilities, good reputation and meet the following basic conditions: 1. Have recycling outlets with reasonable layout and wide coverage; 2. The recycling outlets shall have records through the home appliance trade-in management information system, The ability to check information related to trade-in; 3. Have storage sites that meet environmental protection requirements and sufficient transportation support capabilities; 4. Have trained recycling personnel with certain professional and technical knowledge; 5. Have good operating credit status in the past three years. Article 19 The Department of Commerce of the Autonomous Region and the Bureau of Commerce of the Xingtuan Corps will report recycling enterprises and qualified recycling outlets to the Ministry of Commerce and the Ministry of Finance for filing. The local commerce authorities instruct recycling enterprises to apply to the local industrial and commercial administrative department to increase the scope of renewable resource recycling business, and apply to the local commerce department to register renewable resource enterprises, and operate in accordance with the provisions of the "Renewable Resource Recycling Management Measures".
Recycling enterprises that meet the conditions stipulated in the "Notice on Value-Added Tax Policies for Renewable Resources" (Finance and Taxation [2008] No. 157) issued by the Ministry of Finance and the State Administration of Taxation can enjoy relevant VAT preferential policies. Article 20 Recycling enterprises must sign a commitment agreement and pay a performance bond to ensure that they purchase the used home appliances sold by the purchaser in a timely manner at the price stipulated in these measures, issue trade-in vouchers in a standardized manner, and inspect and recycle old home appliances in strict accordance with relevant regulations. All home appliances will be sold to designated dismantling and disposal enterprises, and no trade-in certificates and old home appliances will be resold, no old home appliances will be dismantled and disposed of without authorization, no fraud will be committed, and no illegal activities such as manufacturing and selling old home appliances will be carried out. Chapter 5 Home Appliance Sales Enterprises Article 21 Professional home appliance chain sales enterprises, comprehensive large-scale retail enterprises, home appliance manufacturing enterprises (sales agencies), etc. can participate in the bidding activities of home appliance trade-in sales enterprises organized by the Autonomous Region Department of Commerce and other departments. Article 22 The sales enterprise determined by bidding shall have strong strength, good reputation, sound sales network, and meet the following basic conditions: 1. The sales outlets have a wide coverage, and the sales enterprise outlets in Xinjiang cover counties (group farms). Level; 2. Sales outlets have the ability to record and check trade-in related information through the home appliance trade-in management information system; 3. Have strong warehousing and distribution capabilities; 4. Have complete after-sales services for home appliance delivery, installation, debugging, and maintenance. System; 5. The operating credit status has been good in the past three years. Article 23 The winning bidder must sign a commitment agreement and pay a performance deposit to ensure that new home appliances are sold at normal market prices, strictly control the purchase of goods, and prevent counterfeit, shoddy, substandard, and old products from entering the market. . Chapter Six Dismantling and Disposal Enterprises Article 24 In accordance with the principles of rational layout and centralized processing, the autonomous region and the Corps' environmental protection department shall jointly determine the dismantling and disposal enterprises, and the enterprises in the Corps shall be responsible for their use. Non-designated dismantling and processing companies are not allowed to purchase and process old home appliances that have been traded in for new ones. Article 25 Dismantling and processing enterprises shall comply with the requirements of relevant national environmental protection laws and regulations, and meet the following basic conditions: 1. In accordance with the "Measures for the Prevention and Control of Environmental Pollution by Electronic Waste" (former State Environmental Protection Administration Order No. 40) Independent legal entities listed in the list of e-waste dismantling, utilization and disposal units (including the temporary list), excluding individual industrial and commercial households; 2. Have relevant environmental, quality, safety and other management and technical personnel; 3. Have the ability to dismantle and process old household appliances Appropriate related facilities and equipment for classification, packaging, storage, dismantling, and processing; 4. There should be proper utilization or disposal plans for old home appliances and their dismantled products that cannot be processed in depth; 5. Have a management information system for the replacement of old home appliances. The ability to record and inspect the dismantling and processing data of old home appliances; establish a record book system for the operation of old home appliances; 6. Have not been punished by the environmental protection department in the past three years. Article 26 The dismantling and processing enterprise must sign a commitment agreement and pay a performance bond, purchase old home appliances sold by the recycling enterprise according to the home appliance dismantling price determined by these measures, and ensure that it does not reject the old household appliances sold by the recycling enterprise without reason. Do not recirculate the purchased old home appliances, do not engage in illegal activities such as manufacturing and selling old home appliances as new ones, and dismantle and process the waste home appliances within the time limit specified by the local environmental protection administrative departments. In principle, the dismantling and processing enterprises should receive the old home appliances before receiving them. The appliances will be disassembled and processed within 60 working days. Article 27 Dismantling and processing enterprises should set up a video supervision system before October 31, 2010 to conduct 24-hour uninterrupted supervision of all imports and exports, dismantling, processing and storage of key areas in the factory. The dismantling and processing plant area should have only one entrance and one exit. Article 28 Dismantling and processing enterprises should set up signboards at prominent locations in the factory to disclose the daily receipt, dismantling, processing and storage of old home appliances, and report the receipt, dismantling, processing and storage to the local environment every 15 days. Record with the protection administrative department. Relevant original vouchers recording the receipt, dismantling, processing and storage of old home appliances should be properly kept for future reference. Chapter 7 Declaration, Review and Payment of Subsidy Funds 1. Home Appliance Subsidies
Article 29 When the purchaser sells old home appliances, he or she shall obtain a national appliance trade-in certificate from the recycling enterprise.
Recycling companies must indicate the product brand, specification, model, body serial number, purchaser's name and ID number of the old appliance on the trade-in voucher. Article 30 Purchasers shall directly declare home appliance subsidies when purchasing new home appliances. 1. The purchase subsidy shall be advanced by the home appliance sales enterprise to the purchaser, and an application for subsidy settlement shall be submitted to the local finance (accountance) department. The autonomous region's winning bidder is a home appliance trade-in sales enterprise (sales outlet) established within the jurisdiction of a prefecture, state, city, or county that has been reviewed and registered, and signs an advance subsidy settlement agreement with the local financial department to provide qualified buyers from the local or corps , adopt direct advance payment by the outlets and apply for subsidy settlement with the local financial department that has signed an advance subsidy settlement agreement. 2. Home appliance trade-in sales enterprises (sales registration outlets) established and approved within the jurisdiction of the Corps Division Headquarters (including Shihezi, Alar, Wujiaqu, and Tumushuk City) and the regiment field shall, based on the principle of proximity, communicate with the Corps Division The financial department of the corps and the corps shall sign a subsidy settlement agreement on behalf of the corps, which shall be responsible for accepting the subsidy settlement for qualified purchasers of the local or corps. For those who meet the subsidy conditions, the sales enterprise (sales registration outlet) will issue an invoice to the buyer based on the sales price, instruct the buyer to fill in the "Home Appliance Trade-in (Home Appliances) Subsidy Fund Declaration Form", and redeem the subsidy funds on the spot according to the normal sales price of the new home appliance. The amount after subtracting the subsidy will be charged. If the subsidy conditions are not met, the purchaser should be informed immediately and the payment will be collected based on the sales price. Article 31 The information that buyers should provide when applying for subsidies: (1) Trade-in voucher; (2) Invoice for purchasing new home appliances; (3) "Home Appliance Trade-in (Home Appliances) Subsidy Fund Declaration Form"; (4) Purchaser Resident ID card or relevant certificates from relevant legal entities. Article 32 Home appliance sales enterprises (sales registration outlets) will sort out purchasers’ application materials every half month, and after review by the local commerce department, apply for home appliance subsidies to the financial (affairs) department at the same level. The finance (affairs) department will complete the subsidy review and confirmation within 7 working days after receiving the application, and the subsidy funds that have passed the review will be paid directly to the basic account opened by the home appliance sales enterprise (sales registration outlet) through the treasury centralized payment method. If there are any doubts about the application materials reviewed, the home appliance sales enterprise should be notified to make corrections and supplements. Finance and commerce departments at all levels must strengthen supervision and inspection of advance subsidies paid by home appliance sales companies to prevent the occurrence of subsidy fraud. 2. Freight Subsidy Article 33 The dismantling and processing enterprise shall review the freight subsidy materials declared by the recycling enterprise. For those that meet the regulations, the freight subsidy shall be calculated and advanced based on the corresponding number of old home appliances. Article 34 Based on the actual number of used home appliances sold, the recycling enterprise directly declares the freight subsidy, which will be reviewed by the dismantling and processing enterprise. For those that meet the regulations, the freight subsidy will be directly advanced. At the same time, the recycling enterprise will be instructed to fill out the "Home Appliance Trade-in (Freight) Subsidy Declaration" surface". If the subsidy regulations are not met, the recycling company should be informed immediately. Article 35 The materials that recycling enterprises should provide when applying for subsidies: (1) Trade-in voucher; (2) Sales invoice for selling old home appliances; (3) "Home Appliance Trade-in (Freight) Subsidy Declaration Form". Article 36 Dismantling and processing enterprises shall sort out the application materials of recycling enterprises on a monthly basis, and after review by the local environmental protection department, apply for freight subsidies from the financial (affairs) department at the same level. After reviewing and confirming the application within 7 working days of receiving the application, the financial department will pay the subsidy funds directly to the basic bank account opened by the home appliance dismantling and processing enterprise through the centralized payment method of the treasury.
3. Dismantling and Processing Subsidies Article 37 Dismantling and processing enterprises shall make statistics on the variety and quantity of old home appliances that have been dismantled and replaced with new ones on a monthly basis, and fill in the "Home Appliances Trade-in for New Dismantling and Processing Subsidy Declaration Form" 》, after being reviewed by the local environmental protection department, apply for subsidy funds from the financial (affairs) department at the same level. After review and confirmation by the finance department, the subsidy funds will be directly allocated to the basic account opened by the dismantling and processing enterprise in the bank. Article 38 The dismantling and processing enterprise shall provide the following information when applying for dismantling subsidies: (1) "Declaration Form for Dismantling Subsidy for Trade-In of Home Appliances"; (2) Voucher for the trade-in of household appliances; (3) Sales of used home appliances issued by the home appliance recycling enterprise Invoice (with purchase list attached); (4) Voucher for freight advanced by the dismantling and processing company (with freight receipt attached); (5) Disassembly record sheet and dismantled product sales voucher or processing certificate.
Article 39 The dismantling and processing enterprise must check the purchased trade-in old home appliances one by one. The physical objects of the old home appliances should be consistent with the trade-in vouchers and the product categories, specifications, models and other information provided by the home appliance trade-in management information system. Those who do not comply with the review shall not apply for dismantling subsidies. In accordance with the requirements of the environmental protection authorities, the dismantling and disposal of old home appliances must be completed within the specified time, and old home appliances that have been exchanged for new ones must not be bought or resold. Article 40 Local environmental protection departments at all levels should strengthen the preliminary review of subsidy forms applied by dismantling and processing enterprises, and review whether the old home appliances have been dismantled, whether the disposal procedures comply with regulations, and the flow of dismantled products. It is necessary to work with the financial department to strengthen the supervision and management of dismantling and processing enterprises, establish a regular verification system, prevent fraud, false claims, false claims, etc., and ensure the safety of financial funds. Chapter 8 Sources, Allocation and Liquidation of Subsidy Funds Article 41 Subsidy funds for trade-in of old household appliances in Xinjiang shall be fully borne by the central government. The management and use of subsidy funds follows the principles of openness and transparency, targeted use and dynamic supervision. After the central subsidy funds are in place, the Autonomous Region Finance Department and the Corps Finance Bureau will issue subsidy budgets step by step through transfer payments. The finance bureaus of various states, prefectures, and cities, as well as the finance bureaus of divisions and regiments of the Corps, adopt the centralized payment method from the treasury when settling subsidy funds.
Article 42 Subsidy funds shall be paid centrally by the treasury in accordance with the relevant provisions on special transfer payments. Article 43 During the implementation of the home appliance trade-in policy, when there is a gap in subsidy funds, the gap in central government subsidy funds will be advanced by the autonomous region's financial department and will be returned after the central government subsidy funds are in place. Chapter 9 Organization and Implementation Division of Responsibilities
Article 44 The autonomous region shall establish a leading group for the “replacement of old appliances with new” work for home appliances, headed by the vice-chairman in charge. The autonomous region’s Department of Commerce, the autonomous region’s Department of Finance, the autonomous region’s Environmental Protection Department, The Propaganda Department of the Party Committee, the Development and Reform Commission of the Autonomous Region, the Economic and Information Technology Commission of the Autonomous Region, the Industrial and Commercial Bureau of the Autonomous Region, the Quality Supervision Bureau of the Autonomous Region, the Commerce Bureau of the Corps, the Finance Bureau of the Corps, the Environmental Protection Bureau of the Corps and other departments are member units. Article 45: The Autonomous Region Department of Commerce and the Corps Commerce Bureau shall work together with the Autonomous Region Finance Department, the Corps Finance Bureau and other departments to strengthen the supervision of bid-winning recycling and sales enterprises and outlets, and do a good job in publicity, training, etc. Ensure smooth replacement of old home appliances with new ones. It is necessary to give full play to the functions of the "12312" complaint service center, set up complaint hotlines and mailboxes, accept reports and complaints from consumers and enterprises, and strengthen market supervision in conjunction with departments such as industry and commerce, quality and technical supervision, and severely crack down on counterfeiting and other illegal activities.
Article 46 The commercial departments of all regions, states, cities, counties, and corps divisions and regiments should set up complaint hotlines and mailboxes to accept reports and complaints. After receiving reports and complaints against recycling and sales companies within the jurisdiction, they should work with relevant departments to find out the facts and deal with them within 15 working days; a public announcement system should be established to give full play to the role of mass supervision, and monitor illegal information at sales outlets and reports and complaints. The handling and other circumstances shall be announced to the public through the Internet, media, etc.
Article 47 The Finance Department of the Autonomous Region and the Finance Bureau of the Corps shall promptly implement the central financial subsidy funds. Finance departments at all levels should appropriately allocate necessary working funds based on the implementation of the home appliance trade-in policy to strengthen policy publicity, business training, sales outlet supervision, supervision and inspection, publicity, and necessary equipment purchase and other business expenses.
Article 48 The Environmental Protection Department of the Autonomous Region shall strengthen the supervision and management of household appliance dismantling enterprises, guide enterprises to carry out the dismantling of discarded household appliances for old ones, implement the dismantling tasks, and guide the environmental protection departments at all levels to dismantle household appliances. Article 49: The Propaganda Department of the Autonomous Region Party Committee, the Autonomous Region Department of Commerce, the Autonomous Region Finance Department, the Autonomous Region Environmental Protection Department, the XPCC Commerce Bureau, the XPCC Finance Bureau, the XPCC Environmental Protection Bureau and other departments are responsible for organizing and carrying out "old-for-new" correspondence for home appliances Business policy promotion and training work.
Article 50 The Economic and Information Technology Commission of the Autonomous Region shall strengthen the management of home appliance production and assembly enterprises in our region, and supervise and guide production enterprises to improve and ensure the quality of home appliances.
Article 51 The industrial and commercial administrative departments at all levels in our district shall regulate the qualifications and business activities of business entities such as home appliance sales companies, recycling companies, and second-hand home appliance markets in accordance with the law, and investigate and punish unlicensed business operations.
