Legal analysis: The same trademark refers to a trademark that uses a mark with identical words or patterns in the same kind of goods. A similar trademark refers to a trademark that is not exactly the same as a registered trademark, but is the same or similar to a registered trademark in shape, pronunciation or meaning. When it is used on the same or similar goods as the goods approved for use by a registered trademark, it is easy for ordinary consumers to have a wrong understanding of the source of the goods.

Legal basis: Article 3 of the Trademark Law of the People's Republic of China applies for registration. Where a trademark does not conform to the relevant provisions of this law or is identical with or similar to a trademark that has been registered or preliminarily approved by others on the same or similar goods, the Trademark Office will reject the application and will not announce it.
