First, if a registered trademark is not used for three years in a row, the probability that the trademark will die will reach 90%.
If a registered trademark, or for some reason, has not been used for three consecutive years, then the trademark is likely to be revoked by the Trademark Office.
Second, the trademark expires, but it has not been renewed, so the trademark no longer belongs to you.
The term of a general trademark is 10 year. At this point, the trademark owner must renew the trademark within the specified time. If you need to continue to use the trademark after 10 years, you must apply for trademark renewal registration one year before the expiration of 10 years, that is, within two months before 12 months. If you don't apply for renewal within one year before the expiration, the Trademark Office will renew it for six months, and you still haven't applied for renewal within these six months.
Third, the trademark is so popular that it is simplified to a common name, which may also lead to the demise of this trademark.
If the trademark owner fails to pay attention to the protection and trademark management when the trademark reputation is hot, so that the trademark is frequently used to describe some products, the trademark will lose its distinctiveness and become a generic name. According to the Trademark Law, if a trademark is reduced to a generic name, it can be revoked by anyone, any company, etc. And then the trademark died!
Fourth, maliciously registered trademarks, the mortality rate is as high as 50%.
Trademarks are sacred and inviolable. If you ignore other people's trademarks and register them maliciously, you can't escape the consequences of invalid trademarks. The Trademark Law stipulates that anyone who maliciously registers other trademarks or imitates well-known trademarks will be required by the prior trademark holder to declare the trademark invalid. Therefore, trademark rights must also be observed.
5. If the company registration information changes, but the trademark does not change.
If the trademark registrant changes the company name, company address and other matters, and the trademark has not changed, the Trademark Office will revoke the trademark. Therefore, trademark registrants should not forget that the company changes and the trademark needs to be changed.
