Can I always apply for a trademark if my application is unsuccessful?
You can't apply repeatedly all the time, but you can submit a reexamination application within 15 days after the trademark registration is rejected. The reasons why the trademark registration application is rejected or partially rejected by the Trademark Office mainly include absolute reasons such as the bad social influence of the trademark and the lack of distinctiveness, and relative reasons such as the trademark and the earlier application or registered trademark constitute similar trademarks in similar goods or services. Among them, the relative reasons for being rejected because of prior trademarks are the most common. However, the rejection of a trademark application by the Trademark Office does not mean that the trademark must be sentenced to death. According to the Trademark Law, if the applicant refuses to accept the rejection decision, he may submit an application for rejection review to the Trademark Review and Adjudication Board within 15 days after receiving the rejection notice. Article 30 of the Trademark Law of People's Republic of China (PRC) If the trademark applied for registration does not conform to the relevant provisions of this Law or is identical with or similar to a trademark registered or preliminarily approved by others on the same kind of goods or similar goods, the Trademark Office will reject the application and will not make an announcement. Article 34 of the Trademark Law of People's Republic of China (PRC) * * * The Trademark Office shall notify the applicant for trademark registration in writing of the trademark whose application is rejected or not announced. If the applicant for trademark registration is not satisfied, he may apply to the Trademark Review and Adjudication Board for reexamination within 15 days from the date of receiving the notice. The Trademark Review and Adjudication Board shall make a decision within nine months from the date of receiving the application and notify the applicant in writing. There are special circumstances that need to be extended, which can be extended for three months with the approval of the administrative department for industry and commerce of the State Council. If a party refuses to accept the decision of the Trademark Review and Adjudication Board, he may bring a suit in a people's court within 30 days from the date of receiving the notice.
