Legal analysis: Trademarks are allowed to be purchased and transferred.
When buying a trademark, you need to pay attention to the following:
1. Similar trademarks are transferred together with the trademark registrant’s similarity registered on the same product. Trademarks, or identical or similar trademarks registered on similar goods, shall be transferred together.
2. A notarized certificate is required. Applications for trademark transfer generally require the submission of the original notarized certificate stating that the trademark transferor agrees to the transfer of the trademark.
3. Whether the nominal address of the trademark registrant is consistent with the name and address on the business license.
Legal basis: Article 43 of the Trademark Law of the People's Republic of China, Article 43 of the Trademark Law of the People's Republic of China can authorize others to use its registered trademark by signing a trademark license contract.
The licensor shall supervise the quality of the goods used by the licensee using its registered trademark.
The licensee shall ensure the quality of the goods using the registered trademark.
If you use someone else's registered trademark with permission, you must indicate the name of the licensee and the place of origin of the goods on the goods using the registered trademark.
When permitting others to use its registered trademark, the licensor shall submit its trademark use license to the Trademark Office for record, and the Trademark Office shall announce it.
Trademark use license shall not be used against bona fide third parties without filing.
