A collective trademark refers to a sign registered in the name of a group, association or other organization for members of the organization to use in business activities to show the membership of users in the organization. When directly applying for collective trademark registration, in addition to submitting the printed application for trademark registration in accordance with the regulations, and affixing the applicant's official seal, trademark pattern, copy of identification document (confirmed by the applicant's seal) and copy of the agent's ID card, it shall also submit the management rules for the use of collective trademarks and the list of collective members.
* * * has a trademark pointing to * * * and a trademark right, which is the trademark right shared by several subjects for the same trademark. When two or more natural persons, legal persons or other organizations can apply to the Trademark Office for registration of the same trademark, they can jointly enjoy and exercise the trademark right. This is a compromise made by many people when applying for the same trademark. Unless other agreements are signed, the transfer, license or pledge of the trademark right of * * * must obtain the unanimous consent of other * * * owners.
It can be seen from the above that * * * has trademarks and collective trademarks, and the applicants are different. The trademark of * * * does not belong to the collective trademark, and there are more differences between the collective trademark and the trademark of * * *, such as
(1) Only collective organizations with legal personality can own trademark rights in the name of their collective independence;
(2) The registration, use and management of collective trademarks shall be subject to unified rules and public supervision;
(3) The ownership and use right of a collective trademark shall not be transferred;
(4) When a collective trademark suffers trademark infringement, the compensation for its losses shall include the losses suffered by all members of the collective organization;
(5) Members can no longer use the collective trademark when they leave the collective. Similarly, new members also have the right to use trademarks when joining.
* * * Some trademarks are not collective trademarks, so it is impossible to apply for trademarks according to the method of collective trademark registration.
