1. If the registered trademark needs to be used continuously after the expiration of its term of validity, it shall apply for renewal of registration within 12 months before the expiration.
2. If no application is submitted within this period, an extension period of 6 months can be approved. If no application is made at the expiration of the exhibition period, its registered trademark shall be cancelled.
3. After the renewal of a registered trademark is approved, it is called the renewal of a registered trademark. The validity period of each renewal registration is 10 year.
2. What is the procedure for trademark renewal?
1. To apply for renewal, each application shall submit an Application for Trademark Renewal Registration, five copies of the trademark pattern of the registered trademark and a copy of the Trademark Registration Certificate (the original Trademark Registration Certificate is not required) to the Trademark Office, and pay the renewal registration fee. If the registrant applies for renewal within the grace period, it shall pay the renewal fee in accordance with the regulations.
2. Examination of the application for renewal of a registered trademark. After receiving the application for renewal of a registered trademark, the Trademark Office does not conduct substantive examination in principle, but only examines whether the procedures for the application for renewal of a registered trademark are complete, whether the name and graphics of the trademark, the goods using the trademark, the name and address of the registrant have changed, and so on. Upon examination, if the Trademark Office considers that it meets the requirements, it shall approve it, notify the registrant in writing, issue the Trademark Renewal Registration Approval Certificate and make an announcement. When it is necessary to produce the Trademark Registration Certificate, it shall be used together with the corresponding certificate. If it does not meet the requirements, the Trademark Office will not renew it and reject the application for trademark renewal registration in writing. If the applicant refuses to accept the rejection of the trademark renewal application by the Trademark Office, he may also apply for a review; If you are not satisfied with the review, you can bring an administrative lawsuit. The period of validity of a registered trademark is 10 year. After the expiration of the validity period, if it is necessary to continue to use it, it shall be examined and approved, and the renewal registration fee shall be paid. Generally, the validity period after renewal of registration is still 10 year.
