Trademark objection defense refers to the legal act in which the opponent in a trademark opposition case files a written defense against the reasons for the objection within the statutory time limit.
After making the opposition ruling, the Trademark Office will send the opposition ruling to the opponent and the opposed party. There are two outcomes for an objection ruling.
1. If the reason for objection cannot be established, the trademark that has been initially approved will be registered;
2. If the reason for the objection is sufficient and the objection is established, the trademark that was initially approved will not be registered.
However, if any of the parties to the objection is dissatisfied with the ruling, they can apply to the Trademark Review and Adjudication Board for a trademark review within 15 days from the date of receipt of the objection ruling notice, and the trademark application for registration will be transferred to the application for trademark opposition.
