Article 9 of the Anti-Unfair Competition Law stipulates that "business operators shall not make misleading false propaganda on the quality, composition, performance, use, producer, expiration date and place of origin of commodities by advertising or other methods" and shall be punished in accordance with the provisions of Article 24 of the Anti-Unfair Competition Law. Article 52 (5) of the Trademark Law "causes other damage to the exclusive right to use a registered trademark of others" shall be punished in accordance with Article 53 of the Trademark Law and Article 52 of the Regulations for the Implementation of the Trademark Law.
