Briefly describe the responsibilities of the Trademark Review and Adjudication Board.

1. Organization: The Trademark Review and Adjudication Board is an organization established in accordance with the Trademark Law and affiliated with the State Administration for Industry and Commerce and independent of the Trademark Office. Although the Trademark Review and Adjudication Board is an internal agency of the administrative agency, it does not have administrative functions, nor is it an administrative review agency of the Trademark Office. It performs review and adjudication functions upon application by the parties. The Trademark Review and Adjudication Committee consists of 1 chairman, 3 vice-chairmen, and several committee members. The Trademark Review and Adjudication Board also sets up an expert advisory group to seek opinions on relevant issues in trademark review matters. The expert advisory group is composed of several legal experts in the intellectual property field, and its members are appointed by the Trademark Review and Adjudication Board. The Trademark Review and Adjudication Board currently has a staff of 70 people with eight divisions, including 1 director, 3 deputy directors, 1 deputy inspector, 9 division directors, and 17 deputy division directors. Based on the above responsibilities, the Trademark Review and Adjudication Board has established 9 functional divisions: General Division, Case Acceptance Division, Case Trial Division 1, Case Trial Division 2, Case Trial Division 3, Case Trial Division 4, Case Trial Division 5, Case Trial Division 6, Legal Division Affairs Office. Comprehensive Division - Responsible for comprehensive administrative affairs; Case Acceptance Division - Responsible for formal review of cases applied by parties; Case Trial Division (Case Trial Division 1, Case Trial Division 2, Case Trial Division 3, Case Trial Division 4, Case Trial Division Division 5, Division 6 for Case Trial) - Responsible for the trial of specific cases. Legal Affairs Department - 2. Functions: handle trademark disputes in accordance with the law. The specific responsibilities are: (1) Accept review applications that are dissatisfied with the Trademark Office’s rejection of trademark registration applications and make review decisions. (2) Accept review applications that are dissatisfied with the objection ruling of the Trademark Office and make a review ruling. (3) Accept review applications that are dissatisfied with the Trademark Office’s decision to cancel a registered trademark and make a review decision. (4) Accept the application for cancellation of a registered trademark filed by the party in accordance with Article 41 of the Trademark Law and make a ruling. Of the above four items, the first three are obviously re-examinations of the Trademark Office's examination procedures. Although the latter's cancellation application is submitted directly to the review authority, the trademarks involved in the cancellation application are all trademarks examined and registered by the Trademark Office. Therefore, their essence is still for retrial proceedings. From the above functions, it can be seen that the Trademark Review and Adjudication Board is the review agency of the Trademark Office. The establishment of this agency is to provide an administrative relief channel for trademark rights holders to better protect the legitimate rights and interests of the parties involved. It can also be seen from the above functions that the responsibilities of the Trademark Review and Adjudication Board are to confirm and maintain the legitimate rights of the parties; to prevent and revoke the unfair rights of the parties. Therefore, trademark review is of great significance for opposing unfair competition and maintaining the market order of fair transactions.
