Initial trademark registration lasts for six years. After the fifth anniversary of trademark registration, the owner must submit a Section 8 declaration form. This indicates to the USPTO that the mark is still in active use. Owners must submit this form on or before the six-year anniversary. Additionally, after the ninth anniversary, the owner must submit both a Section 8 declaration and a Section 9 renewal application. This should be completed before the 10th anniversary of the registration date. Additional Section 8 declarations and Section 9 application renewals are required every 10 years thereafter.
