Article 5 The industrial and commercial administrative departments and technical supervision departments at or above the county level (hereinafter referred to as the supervision and inspection departments) shall be responsible for supervising and inspecting illegal activities in the production and sale of counterfeit and shoddy goods in accordance with the terms of reference stipulated by the state; other relevant departments shall be stipulated by laws and regulations. Article 6 Users, consumers, social organizations, news organizations and other organizations and individuals that protect the rights and interests of users and consumers have the right to supervise the producers, sellers and related parties of counterfeit and shoddy goods.

Supervision and inspection departments should promptly and conscientiously investigate and deal with cases that expose and report counterfeit and shoddy goods. Chapter 2 Responsibilities and Obligations of Producers Article 7 The term “producers” as mentioned in these Regulations refers to commodity production and processing units (hereinafter referred to as production units) and individuals.

Producers must strictly abide by product quality laws and regulations and implement relevant product quality standards. Article 8 The legal representative or person in charge of a production unit is responsible for the quality of the unit's products and shall not force, instruct or condone the unit's staff to produce counterfeit and shoddy goods. Article 9 The quality inspection agency and quality inspection personnel of the production unit shall be responsible for product quality inspection and shall not issue certificates for unqualified products. Article 10 If the quality of a product does not meet the prescribed standards or grades, but it still has certain use value and does not pose an unreasonable risk to human health, personal or property safety, the product or its packaging must be marked with the words "dispose" in a prominent position. Products may be sold only if they are marked with the words "good product", "external product" or "defective product".

Those who violate the provisions of the preceding paragraph shall be treated as counterfeit and shoddy goods. Chapter 3 Responsibilities and Obligations of Sellers Article 11 The sellers mentioned in these Regulations refer to units and individuals engaged in wholesale or retail of goods (hereinafter referred to as sales units).

Sellers must strictly abide by product quality management laws and regulations. Article 12 The legal representative or person in charge of a sales unit is responsible for the quality of the goods sold by the unit and shall not force, instruct or condone the staff of the unit to sell counterfeit and shoddy goods.

Article 13: Sellers must establish and strictly implement a purchase inspection and acceptance system, and are not allowed to purchase counterfeit and shoddy goods. If any counterfeit and shoddy goods are discovered, they must not sell them and report them to the supervision and inspection department or other relevant departments. Chapter 4 Responsibilities and Obligations of Relevant Parties Article 14 Relevant parties as mentioned in these Regulations refer to units and individuals that provide conditions or services for the production and sale of goods.

Relevant parties must strictly abide by relevant laws and regulations when providing conditions or services for the production and sale of goods. Article 15 If the lessor of the site or equipment discovers that the lessee is using the site or equipment to produce or sell counterfeit and shoddy goods, he shall immediately report it to the supervision and inspection department or other relevant departments. Article 16 No unit or individual is allowed to print and sell counterfeit trademarks, counterfeit famous brand signs and counterfeit certification signs.

For printing registered trademark logos, famous and high-quality logos, certification marks, or packaging and nameplates containing registered trademark logos, famous and high-quality logos, and certification marks, the printer shall inspect the relevant certification documents and make copies for retention. If the client cannot provide supporting documents, the printer shall not print.
