Chapter 1 General Provisions

Article 1: In order to strengthen the management of single-purpose commercial prepaid cards, safeguard the legitimate rights and interests of parties, and prevent financial risks, these Measures are formulated in accordance with relevant laws and regulations.

Article 2 Enterprise legal persons engaged in the retail industry, accommodation and catering industry, and resident services industry (see Appendix 1 for specific industry classifications) carry out single-purpose commercial prepaid card business within the territory of the People's Republic of China This method applies.

The term “single-purpose commercial prepaid card” (hereinafter referred to as “single-purpose card”) as mentioned in these Measures refers to the card issued by the enterprise specified in the preceding paragraph and is limited to the enterprise or the group to which the enterprise belongs or the same brand franchise system. Prepaid vouchers for payment of goods or services include physical cards using magnetic stripe cards, chip cards, paper coupons, etc. as carriers, and virtual cards using passwords, string codes, graphics, biometric information, etc. as carriers.

Article 3 Group card issuing enterprise refers to the group parent company that issues single-purpose cards for use within the group. A group refers to a consortium of corporate entities that is absolutely controlled by the same corporate entity.

A brand card issuing company refers to a company that issues single-purpose cards for use within the same brand franchise system and owns the corporate logo or registered trademark of the brand, or is authorized to have the exclusive right to use the corporate logo or registered trademark. corporate enterprise. The same brand franchise system refers to a consortium of corporate entities that use the same corporate logo or registered trademark.

Card-selling enterprises refer to those within the group or the same brand franchise system designated by group card issuers or brand card issuers to undertake single-purpose card sales, recharges, loss reports, card replacements, card refunds and other related businesses. enterprise.

Article 11 The filing authority shall number the registered card-issuing enterprises, announce them on the media designated by the Ministry of Commerce and the filing authority, and provide public inquiry services.

Article 12 When the registration matters change, the type of card issuing enterprise changes, or the single-purpose card business is terminated, the card issuing enterprise shall go through the change and cancellation procedures with the filing authority within 15 working days from the date of change.

Chapter 3 Issuance and Services

Article 13 Enterprises can issue registered cards and unnamed cards, and registered cards can be reported as lost.

Card-issuing companies should record the card-issuing company’s name and contact information, card number, usage rules, precautions, etc. on the physical card surface. Group card issuing enterprises should also indicate the group name, and brand card issuing enterprises should indicate a unified corporate logo or registered trademark. The virtual card should also record the above information. Card issuing companies that have been registered can indicate the registration number.

Article 14 The card issuing enterprise or card selling enterprise shall publicize or provide single-purpose card regulations to the card purchaser, and sign a card purchase agreement at the request of the card purchaser. Card issuing companies or card selling companies should fulfill their obligation to provide prompts and notifications to ensure that card buyers know and acknowledge the contents of the single-purpose card regulations or agreements.

The single-purpose card regulations and card purchase agreement shall include the following contents:

(1) The name, type and function of the single-purpose card.

(2) Methods for purchasing, recharging, using, and returning cards for single-purpose cards. Registered cards should also include methods for reporting loss and transfer.

(3) Charging items and standards.

(4) Rights and obligations of the parties.

(5) Dispute handling principles and liability for breach of contract.

(6) Other matters stipulated in relevant laws, regulations and normative documents.

Article 15 If an individual or unit purchases a registered card (including recharge, the same below), or purchases an unnamed card of more than 10,000 yuan (inclusive) at one time, the card issuing company or card selling company shall require The card purchaser and his or her agent shall present their valid identification documents, and the name or unit name, valid ID number and contact information of the card purchaser and his or her agent shall be retained.

Personal valid identity documents include resident identity cards, household registration books, military identity documents, armed police identity documents, Hong Kong, Macao and Taiwan resident passes, passports, etc. Valid identity documents of the unit include business license, public institution legal person certificate, tax registration certificate, organization code certificate, etc.

Article 16 Card issuing enterprises and card selling enterprises shall keep the registration information of card purchasers for more than 5 years.

Card issuing companies and card selling companies should keep the identity information and transaction information of card buyers and their agents confidential and shall not provide it to third parties unless otherwise provided by law.

Article 17 The amount of a single-purpose card purchased by an unit at one time, or the unit or individual purchasing a card off-site, shall be transferred through a bank, and cash shall not be used. The card issuing company or card selling company shall be responsible for the transfer. , transfer the account name, account number, amount, etc. to register one by one.

Card-issuing companies and card-selling companies should issue invoices in strict accordance with relevant national regulations.

Article 18: Single name card limit.

The fund balance after recharging a single single-purpose card shall not exceed the limit specified in the preceding paragraph.

Article 19: A registered card shall not have a validity period; a bearer card shall have a validity period of not less than 3 years.

Card-issuing companies or card-selling companies should provide supporting services such as activation and card replacement for bearer cards that have fund balances beyond their validity period.

Article 20 If you need to return goods after using a single-purpose card to purchase goods, the card-issuing company or the accepting company should return the funds to the original card. If the original single-purpose card does not exist or the fund balance in the card after return exceeds the single-purpose card limit, it should be returned to the same type of single-purpose card owned by the cardholder in the same card-issuing company.

Article 21 Card issuing companies or card selling companies should provide card refund services in accordance with the single-purpose card regulations or agreements.

When refunding a card, the card issuing company or card selling company should require the person who returns the card to present a valid ID, and retain information such as the name of the person returning the card, valid ID number, refunded card number, amount, and other information.

Article 22: If a card issuer terminates the redemption of an unexpired single-purpose card, the card issuer and the card seller shall provide cardholders with free card refund services and notify the card holders at least 30 days before the termination date. The announcement shall be made on the media designated by the filing authority.

Chapter 4 Fund Management

Article 23 Card issuing companies and card selling companies should regularly check the accounts related to single-purpose card business, record and record transaction data in a timely manner liquidation.

Article 24 Card-issuing enterprises shall strictly manage the funds received in advance. Funds received in advance can only be used for the main business of the card-issuing enterprise, and may not be used for investments and loans in real estate, equity, securities, etc.

Article 25 For card-issuing enterprises whose main business is retail, accommodation and catering industries, the balance of funds received in advance shall not exceed 40% of their main business income in the previous fiscal year; for card-issuing enterprises whose main business is residents The balance of funds received in advance of a card-issuing enterprise in the service industry shall not exceed its main business income in the previous fiscal year; the balance of funds received in advance of a card-issuing enterprise registered with the industrial and commercial registration for less than one year shall not exceed twice its registered capital.

The balance of funds received in advance from a group card-issuing enterprise shall not exceed 30% of the group's operating income in the previous fiscal year.

The term "advanced funds" as mentioned in these Measures refers to the total amount of funds received in advance by card issuers through the issuance of single-purpose cards. The balance of advanced funds refers to the balance of funds received in advance minus the price of goods or services that have been paid.

Article 26: Large-scale card issuing enterprises, group card issuing enterprises and brand card issuing enterprises shall implement a fund depository system. The proportion of funds deposited by large-scale card issuers shall not be less than 20% of the balance of funds received in advance in the previous quarter; the proportion of funds deposited by group card issuers shall not be less than 30% of the balance of funds received in advance in the previous quarter; the proportion of funds deposited by brand card issuers shall not be less than 40% of the balance of funds received in advance in the previous quarter.

Article 27: Large-scale card issuing enterprises, group card issuing enterprises and brand card issuing enterprises shall determine a commercial bank account as a fund depository account and sign a fund depository agreement with the depository bank.

The fund depository agreement should stipulate that the depository bank shall supervise the fund depository ratio of the card-issuing enterprise, reject instructions for excessive transfer of depository funds, and provide the card-issuing enterprise's fund deposit status in accordance with the requirements of the filing authority.

Article 28: Large-scale card issuers, group card issuers and brand card issuers may use guarantee insurance, bank guarantees, etc. to guarantee advance receipt of funds to offset all or part of the deposited funds.

Article 29: Large-scale card issuers, group card issuers and brand card issuers shall establish domestic business processing systems commensurate with the scale of issuing single-purpose cards, and ensure the information security and operation quality of the business processing systems. .

When a major or irrecoverable technical failure occurs, large-scale card issuers, group card issuers, and brand card issuers should immediately report to the filing authority.

Article 30 Card-issuing enterprises shall incorporate single-purpose card business into daily management and formulate systems for settlement of advance funds, risk management, daily supervision, and emergency response.

Article 31: Large-scale card issuers shall log in to the Ministry of Commerce's "Single Card Issuer" within 15 working days after the end of each quarter, and group card issuers and brand card issuers shall log in to the Ministry of Commerce's "Order" within 20 working days after the end of each quarter. "Purpose Commercial Prepaid Card Business Information System", fill in the single-purpose card business situation of the previous quarter. Other card-issuing enterprises should fill in the "Card-Issuing Enterprise Single-Purpose Card Business Report Form" before January 31 of each year (see Attachment 3 for the format).

The information reported by the card issuing enterprise shall be accurate, true and complete, and shall not deliberately conceal or make false statements.

Chapter 5 Supervision and Management

Article 32 The commercial departments of the people’s governments of provinces, autonomous regions, and municipalities directly under the Central Government shall formulate special emergency plans to actively prevent and properly handle matters involving Major emergencies in the single-purpose card business shall be reported to the Ministry of Commerce in a timely manner.

Article 33 The Ministry of Commerce and the competent commerce departments of local people’s governments shall conduct regular or irregular on-site and non-scheduled inspections of the single-purpose card business activities, internal controls and risk status of card-issuing and card-selling enterprises. On-site inspection. Card issuing companies and card selling companies should cooperate with the inspections of the competent commerce departments.

Article 34 The Ministry of Commerce shall establish and improve the "Single-Purpose Commercial Prepaid Card Business Information System". The commercial departments of local people's governments should make full use of information technology to strengthen the supervision and management of card-issuing enterprises.

Article 35 The Ministry of Commerce and the competent commerce departments of local people’s governments shall accept reports and complaints related to these Measures through the 12312 Business Reporting and Complaints Service Platform.
