Article 4 of China's Trademark Law clearly stipulates: "If a natural person, legal person or other organization needs to obtain the exclusive right to use the trademark of its goods or services in production and business activities, it shall apply to the Trademark Office for trademark registration." Moreover, Article 5 of the Trademark Law also stipulates that two or more natural persons, legal persons or other organizations may apply to the Trademark Office for registration of the same trademark and enjoy and exercise the exclusive right to use the trademark. Therefore, the right to apply for a trademark belongs not only to legal persons or other organizations, but also to natural persons. Moreover, two or more natural persons can jointly apply and jointly enjoy and exercise the exclusive right to use a trademark.
