What kind of trademark is non-transferable?

1. Trademarks used for two similar commodities cannot be transferred independently. When trademark registration requires that a trademark can be used for two or more kinds of goods, if it belongs to non-similar goods, the trademark of each kind of goods can be assigned separately. If it belongs to the same kind of goods, it should be completely transferred. Allowing the division and transfer of such trademarks will violate the requirements of the Trademark Law, causing two trademark registrants of the same trademark to use similar goods at the same time, thus confusing the goods of different manufacturers;

2. Joint trademarks cannot be transferred. Joint trademarks are a series of trademarks applied by trademark applicants according to the needs of commercial services. It has similar characteristics. If one of the joint trademarks is allowed to be transferred independently, the users of two trademarks on the same commodity will also apply for similar trademarks, which will lead to confusion of the origin of the goods;

3. Trademarks belonging to the right of common use shall not be transferred independently without the permission of others. When the application for registered trademark belongs to two people, a part of each * * * must obtain the permission of a part of other * * * to transfer part of its own interests;

4. Trademarks authorized by others cannot be transferred casually. Where a registrant of a trademark application permits others to apply for a trademark, he must transfer his patent application right to a third party within the licensing period and obtain the permission of the licensor.
