A sound trademark refers to a trademark consisting of the sound itself used to distinguish the source of goods or services. A sound trademark can be composed of musical sounds, such as a piece of music; it can be composed of non-musical sounds, such as natural sounds, human or animal sounds; or it can be composed of sounds of both musical and non-musical natures. This part provides for the formal examination and substantive examination of sound trademark registration applications. The substantive examination of sound trademarks includes examination of prohibited clauses, examination of distinctive features and examination of identical and similar trademarks. Sound trademarks are reviewed for registrability as a whole.

Article 13 of the "Regulations for the Implementation of the Trademark Law of the People's Republic of China" If applying for trademark registration with a sound mark, a statement must be made in the application, a sound sample that meets the requirements must be submitted, and the application for registration shall be reviewed. Describe the sound mark and explain how the mark is used. To describe a sound trademark, the sound applied for trademark registration should be described in five-line notation or simplified musical notation, and a text explanation should be attached; if it cannot be described in five-line musical notation or simplified musical notation, it should be described in words; the trademark description and the sound sample should be consistent.
