First of all, the litigation costs that the parties should pay to the court include:
1. Case acceptance fee. Including the first-instance case acceptance fee, the second-instance case acceptance fee and the partial retrial case acceptance fee. Retrial cases that need to pay the case acceptance fee include: cases where the parties have new evidence enough to overturn the original judgment or ruling, apply to our court for retrial, and the retrial court decides to retry; A case in which the parties have not appealed against the judgment or ruling of the court of first instance, but apply for retrial after the judgment or ruling of first instance or the conciliation statement becomes legally effective, and the court decides to retry after examination.
2. Application fee. If a party applies to the court for the following matters according to law, it shall pay the application fee.
Witnesses, expert witnesses, translators and adjusters appear in court on the date stipulated by the court, and provide transportation, accommodation, living expenses and lost time subsidies. This fee will be charged by the court in accordance with national standards. When copying files and legal documents, the parties concerned shall pay the production fee to the court according to the actual cost.
Secondly, the situation of exemption.
If a party applies for judicial assistance under any of the following circumstances, the people's court shall grant exemption from litigation fees:
(a) the disabled have no fixed source of income;
(2) recourse for alimony, alimony, child care and pension;
(three) the minimum living security object, the rural poverty relief object, the rural five guarantees supporting object or the person receiving unemployment insurance benefits, and there is no other income;
(four) because of the courageous behavior or the protection of public interests, so that their legitimate rights and interests have been damaged, and request compensation or compensation;
(five) other circumstances that really need to be exempted.
When a party brings a lawsuit to a people's court, it shall pay a certain fee in advance, that is, legal fees. The collection of legal fees includes case acceptance fees and other legal fees. If a party fails to pay or pay the legal fees on time, it may be regarded as withdrawing the lawsuit.
